Sarah Palin Threatens to Sue ‘Rogue’ Book Publisher

Sarah Palin’s family attorney John Tiemessen has written a letter to Maya Mavjee, the publisher of the Crown Publishing Group, a division of Random House, that Palin may sue her, the company, and the book’s author Joe McGinniss “for knowingly publishing false statements” in his book released last week, “The Rogue,” ABC News has learned.

The book was widely panned by critics for using unnamed sources to criticize Palin and her family. Tiemessen cites an email they have access to in which McGinniss writes that attorneys from Crown Publishing told him “nothing I can cite other than my own reporting rises above the level of tawdry gossip. The proof is always just around the corner, but that is a corner nobody has been able to turn” and that McGinniss “ran out of time” to sufficiently source the book.

A source close to the Palins tells ABC News that the “Palins are fighting back and demanding answers from Random House.”

“Random House is at the top of the food chain and published a book based upon acknowledged unsubstantiated gossip,” the source said. “The revealing email is key as evidence of this defamatory approach to politics through proxies.”

Tiemessen writes in the letter that the email “clearly describes the fact that Mr. McGinniss researched and investigated many false and scurrilous allegations, and concluded that there was absolutely no evidence anywhere backing these allegations.”

Palin’s attorney writes that it is “malicious” for Crown to publish the book when it has proof McGinniss and Crown “were fully aware the statements in the book were false, intended to be false, and were intended to harm.”

Discovery, and in this case eDiscovery, can be very effective.

Exactly. Discovery is what outfits like Random House fear more than money loss.

We are seeing this in the Duke lacrosse lawsuit. Duke is willing to spend as many million$ as it takes to delay or avoid discovery.

If she makes it abundantly clear that she will not be anybody’s doormat, I think it’s a good bet that she’ll be running.

My big problem with so much of what is going on in this country is the lawlessness, while politicians all seem to think they would be “uncool” if they ever confronted it. Sarah is saying loud and clear that she’s not gonna stand for it. Truth matters.

Someone who still believes truth matters. I almost have to weep over it, I’m so parched in this current desert. This country needs this woman to be our President.

Wasn't a threat, was a demand letter, a huge world of difference, a threat is nothing, a demand letter and lawyers is of an entirely different dimension.

I was wondering why Joe McPenis was whining Mourning Joe of PMSNBC and Olberman at Current TV along with other lefty venues were canceling interviews with him? Now it becomes clear, with that one letter from Palin’s Lawyers, they dast not expose their deep pockets by getting involved in the McPenis lies.

Palin would have almost no chance of winning in court.

I think she can win the liability issue on summary judgment, leaving only the damages to be determined.

Being a public figure means that she has to establish malicious intent and disregard for the truth, this book is so far beyond the pale, it should be quite easy to established.

One thing is certain, if this case were to reach the USSC and CJ Rhenquist was still alive, it would be a 9-0 decision and Rhenquist would assgn himself to write the opinion. He ws death on slander and defamation. He wrote most, if not all, opinions in defamation cases while he was the CJ.

Not NEARLY good enough.

They were allowed to drag this rank detritus into the public square, accompanied by the usual anti-American CommieMedia coverage.

Now, being allowed to quietly pull the book off the shelves, will not even come close to assuaging the damage that has been done.

Even Keith Olbermann and NPR refuse to let that dirtbag on their shows.

The reason for that is if they permitted him to spew his bile on their shows, Sarah would has a cause of action against them for republishing the slander while knowing they were all malicioua lies.

It's about time! Sarah has the evidence to sue McGinniss and evidently her lawyers believe they can prove malice.

McGinniss is a powerful example of all that is wrong with the MSM, which rely on gossip and unsubstantiated rumors to fill the pages of a book. For three years, Sarah has endured the abuse and ridicule by this so called journalists. I’m thrilled that she is taking this sorry excuse for a man to the woodshed.

I agree with the previous poster...the “letter of demand” comes first, usually with a specific demand that must be accomplished within five or ten days from receipt. This is the first step...then the “Petition” will be filed in Wasilla (even better). Then the fireworks begin...each defendant (this is the critical part) will have 30 days to file an “Answer.” The defendants will include everyone connected with this book in any way. After each Answer is filed, then each of the defendants will motion the court to release them as a defendant. They will each try to worm their way out from being a defendant, hearing after hearing, brief after brief, motion after motion. Each defendant will be forced to hire an Alaskan attorney, and each hearing will be in Wasilla. The costs will be incredible for each of the defendants. Sarah’s costs will also be very high, but not in comparison.

Tough case to defend given that critical evidence has found its way into the public domain prior to any suit being filed. Random House will hire the finest attorneys who will do all the briefing, and then they will send their briefs to the Alaskan counsel to file (after he modifies it to Alaskan law. Sounds like an economic boom for Wasilla and Alaska. Lawyers, filing fees, depositions, travel, airfare, meals, hotels, office supplies, printing companies, etc., etc.

Sarah will actually create an economic boom for Alaska…don’t ya just love it? You betcha!

The phrase is actually "malicious disregard for the truthfulness."
