A Milpitas man who used a computer to paste photos of his 13-year-old daughter's head onto bodies of women in graphic poses shouldn't have been convicted of possessing child pornography because the pictures didn't show minors engaging in sex acts, a state appeals court ruled Wednesday.
California's child porn ban, punishable by up to three years in prison, "requires a real child to have actually engaged in or simulated the sexual act depicted," said the Sixth District Court of Appeal in San Jose.

We do. Most “hate crimes” and a lot of “sentence enhancement” punishes the attitude, or perceived attitude, of the offender.
He won his case, but lost his reputation and all respect as a father. Sometimes one just must not act on all those crazy thoughts our brain cooks up.
I have dealt with mentally handicapped children who seemed to have more cognitive abilities than the typical judge you read about these days...

Our neighbor admitted that he looks at his fourteen year old daughter’s boobs when she wears a bathing suit.

I told my husband that this pervert is never to be left alone with my girls.
This guy needs to be put away...it’s only going to lead to trouble once he feels bold enough to act out his fantasies at the very least have the daughter be taken away from the dad...is the daughter aware of this issue

You got a HUGE clue to the character of this guy. I would avoid him like the plague. I would tell my daughters to avoid him like the plague as well. Anything can be explained to a child, no matter the age, depending on how you phrase it. Your story gave me goose bumps!

Somebody explain to me why on earth a father attaches his daughter’s face to porn photos much less why anyone would defend it? Granted, I wouldn’t categorize it as “child pornography” but I would certainly have CPS take the child away.
BTW, I’ll bet there is some genuine child porn in the man’s house. Such behavior has to have a genesis somewhere.

The damage this man has caused his own daughter with just this one selfish act alone is completely unforgivable. A father exploiting his own daughter's vulnerability...I guess there may be greater sins...maybe I just can't think of them.
"Hate crimes" is a term created by leftists to add more penalties for real or imagined crimes, if the leftists suspect the motive was politically incorrect, such as racism, islamophobia, etc.
Conservatives generally reject the premise of "hate crimes".
There are crimes (violations of people's actual, not imagined, human rights) and then there are non-crimes.

The thought in and of itself is not a cause to arrest and persecute.
It is an enhancement to a physical crime.
