The Illinois Supreme Court has granted Rahm Emanuel's stay. Which means he's back on the ballot.

Earlier today Emanuel's spokesman Ben Labolt said he had plans to turn to the U.S. Supreme Court if Emanuel doesn't receive a favorable ruling from the state.

Emanuel's lawyers filed an emergency appeal with the Illinois Supreme Court, asking to have him re-added to ballots. Today, ballots are being printed without Emanuel's name after an Illinois Appellate Court residency decision on Monday booted him.

Some believe Emanuel will look at a First Amendment question for the U.S. court to weigh in if a state ruling doesn't go his way

The antics of the unions back in the 60s and 70s managed to get them to where they went from what, 40% (?) down to 15%. After they get through with this round of looting a few mobsters may wind up rich, but there aren’t going to BE any unions in America.

"It’s very unlikely that SCOTUS would accept the case. They have refused to do so in several similar cases, including the NJ senate race where the Democrats cheated in 2000 and the recent race in Alaska where Murkowski supporters cheated.

Extremely unlikely the Supreme Court would intervene - the cases cited above, arguably, have a federal component since they decided a member of Congress. The election of the major of Chicago has no federal component (well, except when Daley stuffed the ballot boxes for Kennedy - but that's pretty remote.)

My aunt and uncle lived in the Chicago area for 50 years. Recently they defected and crossed the Cheddar Curtain to join us in WI.

The first time Auntie and I discussed Rahm running for mayor, and the ballot trouble, she said he will be the mayor. Legal or not doesn’t matter, he will be mayor.

Maybe, but the Appellate court has done a fair job of showing the municipal code requires actual and not merely constructive residence specifically for candidates as opposed to voters. If the SC wants to avoid trashing ordinary statutory construction (and even the dems would have some motivation to that effect), Rahm must lose:

I read the decision and the dissent and think in this case the dissenter has the better of the argument. Rahm Emannuel remained a resident of Chicago while he was in D.C. because he had always intended to return, and only rented out but did not sell his home, in which he left some important personal property.

I think Rahm will prevail in the Illinois Supreme Court and be elected Mayor of Chicago.

Now perhaps Obama will claim that he had always intended to be born in Hawaii. LOL.

Not all registered voters can be mayor of Chicago. Even Richard M. Daley (died 1976) can no longer run for mayor, whether or not he votes.
