Gov. Paterson calls for snow slowdown probe (NYC sanitation union facing criminal investigation)

Outgoing Gov. David Paterson called this morning for a criminal investigation into allegations that a slowdown by budget-squeezed plow operators contributed to the city’s blizzard woes.

The Post reported today that a group of guilt-ridden sanitation workers confessed their protest plot to City Councilman Dan Halloran (R-Queens). The workers were fuming over recent job cuts and cutbacks, the councilman and other sources told The Post.

But is there a point when the outrage itself become outrageous? After all, it was an awful lot of snow. Or is outrage something every New Yorker needs to experience to pull through? Can we all learn to stop complaining and love the plows?

Mr. Polan, the sanitation commissioner from 1990 to 1992, was spared a blizzard during his tenure. “I was fortunate,” he said. The reality is, to plow every street quickly enough to avoid outrage is unfeasible, he said.

Manslaughter is too weak. Second degree murder by depraved indifference to human life should be the charge, and for every union member, not just the leaders, as they all acted in concert.

That's a very good point.

New Jersey governor Chris Christie has a lot detractors here on FreeRepublic (and deservedly so), but I gotta give the guy a lot of credit for one very big accomplishment that I never would have believed possible in my wildest dreams. Within six months of taking office he effectively reduced public school teachers to a level of public respect somewhere above arsonists and below lawyers.

While I am all for self reliance and I also realize that no matter how well you do the job, it is impossible to clear all the streets in a really heavy snow storm, in this case this was a deliberate act of not working, people pay exorbitant taxes in NYC so that the street cleaners will do their best to keep the roads clear. They didn't do their best or even their second best and are therefore liable for whatever legal action can be brought against them.

I see a lot of people posting about how New Yorkers could help themselves out of this mess but this goes way beyond simply waiting for "George to do it". NYC has to haul the snow off in trucks, people getting out with shovels won't do any good because there is no place to put the snow except up on the sidewalks.

RG did a good job during winter weather when he was Mayor and so do some other cities that face the same types of problems NYC has with snow. Bloomberg(sp?)is an idiot and cares little for the people who live in his city unless they are muslims.

This should be the Dem's Katrina. In addition to the unions' purposely moving slow on NYC streets, Ray LaHood is silent on the airline backlog issue. HE helped issue regulations that fine airlines for long waits on tarmacs (why airlines cancelled so many flights)...long waits due to NO snow plowing by...THE UNIONS!!

I would absolutely bring them up on manslaughter charges. I can't believe that poor baby died because the ambulance couldn't get to the mom in time.

The lawsuits are going to be amazing. Trial lawyers vs. Union thugs vs. bureacrats. This is going to get real ugly.

There are some serious implications to that photo that go way beyond the whole notion of a driver sleeping on the job.

Anyone who plows snow for their job will tell you that during snowstorms they often work double shifts -- or even more. For anyone driving a vehicle that requires a commercial driver's license (CDL), there are some serious legal/safety ramifications to this that are usually ignored and swept under the rug. Federal regulations under the Federal Motor Carrier Safety Administration (FMCSA) prohibit the operation of a commercial vehicle (bus or truck) for more than 11 consecutive hours -- and prohibits a commercial driver from being "on duty" for more than 14 consecutive hours (during which he/she can actually be driving no more than the allotted 11 hours). The same Federal regulations require a driver to be off-duty for a minimum of ten consecutive hours after working a shift.

I wonder how many snowplow drivers are actually operating within those hours?

And the taxpayers are going to foot the entire bill -- including the legal fees AND the cost of the settlements.

Well, under this deliberate slow down I would say they were all within the legal hours and then some.
