Finally, someone in real law enforcement gets it.

There are multiple circuit court and Supreme Court precedents that say that refusing a request for a voluntary search is not grounds for an involuntary search.

The US Code giving TSA the authority for a search is explicitly voluntary. It says that they are required to search people and cargo that WILL BE boarding a plane. The emphasis is mine, but those specific words are used.

Once you decide that you don't want to board the plane, TSA's authority to search you vanishes. US district and circuit court decisions differ on this point, but the most (in)famous one appears to intentionally misquote the law to rationalize their decision.

Unless Congress acts and specifically specifies this, this point is probably going to have to go to the Supreme Court. And right now, I'm not optimistic.

All your important belongings are OUT OF YOUR CONTROL while you are being touched. Your passport, wallet, money, keys, phone, baggage are OUT OF YOUR CONTROL while this is happening. You are completely vulnerable.

Understand the situation the government has placed you in. You are made naked by a machine or a stranger is touching your privates, and you have no posessions.

There are those here who have said the Oath keepers ( or something like that) will not follow illegal orders.

Guess what, TSA is now molesting our children we the excuse is “just following orders!” And not a single arrest made of a TSA agent (or any that have quit).

We are subjects. And yes, the boys and girls in uniform will just follow orders.

Serious about security, I think not. When the DHS, the congress and the administration start dealing with the border, the already present illegal immigrants, and the Muslims among us, none of whom have taken a position in favor of America, then I’ll believe DHS/TSA is serious about security. Besides that, with all the America hating Muslims among us, they can blow up something as newsworthy and spectacular as an aircraft, while thumbing their noses at the TSA agents that are busy harassing Americans at airports. If anyone has any doubt as to how tolerant Muslims are of other believes, just look at their homeland where there is no tolerance at all.
And, besides that, profiling works and every cop on the street profiles since, without profiling, law enforcement would be just as ineffective as the TSA random molestations. The gross stupidity of the government, and TSA in particular, was evident in the screening of pilots, based on some absurd notion the pilot would need an explosive to total a plane. The whole process is not about security, but submission of Americans and compromise of our liberties.

Welcome to yet more Soviet Amerika. Just another reason I refuse to fly any more. If I can't drive there, I ain't going. I refuse to go through that crap any more. The last time was my LAST TIME! I got sick of it. If you must and have to fly, you have my sincere condolences. Otherwise, this kid stays in the expensive gas vehicle.
