JUNEAU -- GOP nominee Joe Miller is asking a federal judge to keep the state from using discretion in counting write-in ballots in Alaska's hotly contested Senate race.
The lawsuit, filed Tuesday, comes the day before election officials planned to begin counting write-in ballots that could determine the outcome of the race.

I don’t see how a write in vote COULD be counted for a candidate if the name is misspelled. If the spelling isn’t right, then that’s not who the voter cast a ballot for. Simple as that.

I have a hard enough time spelling my own name right. You can carry a Del Monte can around to get YOU close. People see a “ski” at the end of a name and freeze up.
Amen, it has to be spelled 100% PERFECT or no count. It seems that is what the ruling was when they allowed her unorthodox write-in candidacy.
The Alaska Lt. Governor has a job that is little more than warming a seat, just in case the governor croaks. One of the few actual responsibilities they have is overseeing electoral vote counts.
Alaska’s Lt. Governor was on with Mark Levin last night, and Mark took him to task for allowing those who are counting the Senate race votes to subjectively decide upon a write-in voter’s “intent”, instead of applying the letter of the Alaskan election statutes which clearly state that votes have to be tallied objectively by simply reading what’s on the ballot.
It appears to me that the Miller camp heard this conversation last night, and filed suit immediately to force the Lt. Governor to apply the law as written.
By the way, Mark had Joe Miller on a couple of nights back, and he told Joe in no uncertain terms that he’d better get his lawyers to the courthouse right away, if he intended to have the votes counted according to the law.
Looks like they listened to him. Good on them.
Well, Murkowski is using her daddy's pet judges to do everything to ignore the laws and to fix the race for the Kow. And Murkowski is proving beyond a shadow of a doubt that she doesn't give a tinker's damn about the law.
Are the election officials Democrats. What about the sec of state.
Beltway establishment is in the tank for Murkowski. Plenty of Union support, outside cash and cross-over votes from Dems....not to mention her family name is big in Alaska.
If she wins, I expect her to keep her seniority and current assignments. If the the GOP gets the majority in 2012, Lisa will no doubt get a chairmanship seat.
She is the poster child of what’s wrong with the GOP establishment. If victorious, expect the MSM to say “Oh Noooooo....Sarah is finished!!!!”
Looks like he had better sue to recount those “voter intent” ballots. It will no doubt remove several thousand votes from the Kow.
Princess had a boatload of bracelets and pens printed with her name (on the downlow, of course).
Probably enough sightings and pics of these surfaced, so Miller ought to have standing, since Princess went to expense and hassle to make SURE her people got the name right.

Interesting that there is a constant mention of Lisa Murkowski, she gets paragraphs as to ballots for her, but then all the rest of the write-ins get lumped together. Can you say FRAUD, THEFT, Murkowski owns enough people to manipulate the will of the people?
I can’t find the danged law with regard to what it has been for write-ins. There must be a law, but I don’t know how to research that :(

The write in oval must be filled, and the write in name must MATCH the write-in declaration.
That's Alaska law and the election commission is trying to make it's own law against the standing Alaska law.
OMFreakingGosh! This is a HUGE election fraud moment in Alaska... it is sooooo obvious!! Worse than in Algore vs Bush when the bug-eyed guy was starring at the pregnant chads!!!
