Ellmers claims victory; Etheridge wants votes counted

Raleigh, N.C. — Seven-term Democratic Congressman Bob Etheridge appeared late Tuesday to lose his re-election bid, becoming the lone casualty among North Carolina's congressional delegation in a pivotal election nationwide.

The Associated Press declared Republican challenger Renee Ellmers the victor in the Second District race shortly before midnight. With 100 percent of precincts reporting, Ellmers had about a 2,100-vote lead over Etheridge.

Etheridge, however, wasn't ready to concede defeat.

"I’ve been in close elections before, and we will follow the established process to ensure the integrity of the outcome. We will make sure every vote is counted and every voice is heard," he said in a statement.

"For all the naysayers on both sides of the aisle, it feels really good to stand up here (and claim victory)," Ellmers told cheering supporters at her campaign headquarters in Dunn.

Ellmers, a Harnett County nurse who was given little chance of victory a few months ago, rode a wave of voter discontent and the fallout of an online video depicting Etheridge confronting a man on a Washington, D.C., sidewalk to edge by him.

re: Minnesota, Franken and Coleman. Keep recounting, until you win. They know how many votes they have to divine, find in a lock box somewhere, ...... This time Republicans need to fight, unlike the Coleman/Frankenstein debacle.

This kind of thing infuriates me, regardless of whose ox is being gored. Unless there are credible reasons to believe the original count is illegitimate, recounts should be banned. The reason? There is error in every count (hopefully nominal). There is no reason to believe that a second, third, or tenth recount will produce a result any more accurate than the first.

That's why Florida in 2000 was such a frightening moment. When you're talking about margins in the hundreds from a total in the millions, you really can just count them until you get the result you want.

It's a state-by-state deal -- not a national rule. The details are below, but note that the law invokes a recount if the margin is within 1% OF ALL VOTES CAST.

NC Statute: § 163‑182.7. Ordering recounts.

(a) Discretionary Recounts. – The county board of elections or the State Board of Elections may order a recount when necessary to complete the canvass in an election. The county board may not order a recount where the State Board of Elections has already denied a recount to the petitioner.

...
(c) Mandatory Recounts for Ballot Items Within the Jurisdiction of the State Board of Elections. – In a ballot item within the jurisdiction of the State Board of Elections, a candidate shall have the right to demand a recount of the votes if the difference between the votes for that candidate and the votes for a prevailing candidate are not more than the following:

(1) For a nonstatewide ballot item, one percent (1%) of the total votes cast in the ballot item, or in the case of a multiseat ballot item, one percent (1%) of the votes cast for those two candidates.

(2) For a statewide ballot item, one‑half of one percent (0.5%) of the votes cast in the ballot item, or 10,000 votes, whichever is less.

I tend to agree. In the case of optical ballot readers, you would have to feed these through a central machine for a recount, which may be calibrated altogether differently from the scanner used at the polling place, resulting in slightly different readings on a batch of thousands of ballots. Meaningless. The only other method would be a manual recount, which everyone knows would be rife with fraud.

George Will had it right in an excellent article he wrote during the 2000 FL recount debacle. Paraphrasing, he said that the most accurate count is always the first "double blind" count; after that, each side knows exactly how many "votes" they need to pull off a win, and the temptation to imagine a vote where there is not an ascertainable vote is too much for anyone lower than an angel to resist.
