'Birther' Lt. Col. Terry Lakin to be court-martialed for refusing order to deploy to Afghanistan

An Army doc who refuses to go to Afghanistan until President Obama produces a birth certificate will face court-martial.

Lt. Col. Terry Lakin, a decorated military man who has become a part of the fringe "birther" movement - which believes President Obama was not born in the United States - could face a dishonorable discharge for failing to obey orders, MSNBC reported on Tuesday.

The 18-year veteran came out in support of the largely discredited conspiracy theorists at the end of March, proclaiming he would "disobey" his "illegal" orders to deploy.

"I believe all servicemen and women, and the American people, deserve the truth about President Obama's constitutional eligibility to the office of the presidency and the commander in chief," he said in a video statement posted on YouTube on March 30.

The Bronze Star Medal recipient refuses to go to Afghanistan for a second tour until Obama releases his birth certificate showing he was, in fact, born in the U.S.

"Seeking out public office, especially the highest in our land, means you must uphold the Constitution, Mr. President, and confirm your eligibility," Lakin said in the video.

The Army doctor was informed of his court-martial by his brigade commander, and his Pentagon building pass and laptop have been seized, MSNBC reported.

That’s the whole point: are the orders lawful or not?

The military has historically taken a very dim view of soldiers who question whether their orders are lawful. Officers who refused to go to Iraq, claiming the war was illegal, and specialists who refused to deploy to UN assignments, claiming that was illegal, have found themselves on the wrong end of a court martial verdict. Shall we champion their causes as well?

The military runs on discipline and discipline requires people to obey orders. If Lakin is convinced Obama is illegitimate and feels that he can't take orders from anyone in his chain-of-command because of it then he should have done the honorable thing and resigned 18 months ago when Obama was inaugurated. Or taken his stand then. Waiting 18 months until he's ordered overseas makes the timing of the whole matter look a tad suspicious.

I do not question Lt. Col. Terry Lakin’s loyalty, bravery, or dedication to duty. He may very well be a patriot who is standing on principle. That being said, however, you cannot allow individual members of the military decide under what circumstances they will deploy, obey orders, etc. For Lt. Col Lakin, the issue is the question of Obama’s legitimacy as President. You cannot allow a precedent to be set here that could open the floodgates for other members of the military to refuse to deploy for other, completely unrelated reasons, or disobey an order which they believe to be without merit.

I hate the term “fringe group” pertaining to birthers. When over 50% of the population want to see Obummer’s birth certificate and other credentials, that is NOT a fringe group...that is a majority. Lt. Col. Lakin’s commanding officer, having taken an oath to uphold the Constitution, and protect us from enemies, foreign and domestic, should have joined LC Lakin instead of beginning court martial proceedings.

LTC Lakin is required to take an oath to uphold the Constitution of the United States of America...until he is assured that impostor in the WH is eligible....I would say he is a very brave man and has put everything on the line for his country.

I admit that I was born at night, but not last night. You clearly aren’t listening to what I am saying. I don’t have an argument against the issue. The point that I made and will continue to make is that active duty military personnel do this at their peril, especially commissioned officers.

The Chief Justice of the Supreme Court swore the man in, the Congress accepted the votes of the Electoral College. The military’s job is to follow the orders of their Commander-in-Chief. The Congress and the Judiciary have the responsibility to deal with a usurper.

And you would do well to limit your comments to the points of your argument, rather than attacking those who disagree with your view.

The problem is he has no way to know if these deployment orders are legal because he does not know if the person giving those orders (Commander in chief, President of the United States, currently barack hussein obama) is legally entitled to give those order.

Under this logic, every person in the military can delay compliance with any order until they view the commission orders of all officers in their chain of command. Do you really want that?

It is in the UCMJ ( Universal Code of Military Justice.) You do not have to follow an unlawful order.
