My final thought on the birther issue

A lot of you have asked if I’ve gotten any more emails. Below the fold, a compilation of emails that have come in. But above the fold, my final word.

Based on the facts, it is very clear that President Obama is our lawfully elected President and the Office of President of the United States of America requires that though we may disagree with him and oppose him, we recognize and respect his position as President — a position entrusted to him by 69,456,897 voting Americans, or 52.9% of the popular vote.

As early at 1350, the British Parliament approved statutes recognizing the rule of jus sanguinis, under which citizens may pass their citizenship by descent to their children at birth, regardless of place. Similarly, in the its first naturalization statute, Congress declared that ‘the children of citizens of the United States, that may be born beyond the sea, or out of the limits of the United States, shall be considered as natural born citizens.’ 1 Stat. 104 (1790) . . . . Notwithstanding the Supreme Court’s discussion in Wong Kim Ark (1898), a majority of commentators today argue that the Presidential Eligibility Clause incorporates both the common-law and English statutory principles, and that therefore, Michigan Governor George Romney, who was born to American parents outside of the United States, was eligible to seek the Presidency in 1968.

Even were the American public to fall under the belief that Barack Obama was born in a foreign country and 49 years ago his associates fabricated a narrative, a birth record, and placed birth announcements in both the Honolulu Advertiser and the Star Bulletin on August 4, 1961, to ensure that 49 years later he could become President of the United States, it is undisputed that Barack Obama’s mother is and has always been an American citizen. Therefore Barack Obama is and has always been an American citizen.

The leaps of logic and reason to arrive at such a conspiracy are unbefitting the credibility of anyone and not worthy of further discussion. Notwithstanding the same, no American should ever sanction what would amount to a judicial coup — the removal of the President of the United States after 52.9% of the American public instructed their Electoral College representatives to place their votes for him. The time to even be willing to entertain these issues from those who claim a conspiracy has long past.

A conservative movement worthy of leading this nation must be willing to cast aside those who, for whatever reason, cannot and will not be persuaded that the President is our legitimately, constitutionally elected President.

Constant fruitless litigation without standing, and perpetual assertion of nonexistent duty to produce documents? Crazy? Maybe.

Mrs. Mad may be on to something. Sometimes I think he’s just so arrogant he doesn’t want to answer to the people. Maybe I’m off base, but I would think being only half American would not make him “natural born” & is what should be the grounds for his being an usurper. I believe Orly & others may be using the wrong tactic and duel citizenship would make a better argument in court. But then again, I’m not a lawyer. I just know he’s not an American at heart.

It doesn't matter in this instance. The law was repealed!
Repealed on January 29, 1795...
The guy is basing his argument on a law that was repealed. (which he conveniently forgot to mention making him deceptive in his nature)

IMO, if this issue is not resolved then America is no longer a nation of laws and is a nation of political convenience, making it the laughingstock of nations around the world.

The matter is effectively dead without dramatic, extrinsic evidence of his birth outside of the states. But this is a wholly different matter and the facts do not warrant denigrating the whole of the "birther" movement as crazy or racist. But even that reservation is a losing argument in the battleground of popular ideas.

I would agree you with you about not denigrating birthers, but the truth of the matter is many of them are verbally abusive toward anyone who disagrees with them on any issue, even when factual refutation is presented.

I have repeatedly seen conservative blog owners pushed to exasperation by birthers, who are not regular posters, swarming onto a blog and making long, rambling, often nonsensical, repetitive and sometimes verbally abusive arguments.

There are also birthers who are regular posters who can't resist going OT on every thread to talk about eligibility, annoying everyone in the process.

On FR, there's been a concerted effort by a group of Freepers to get other members banned for disagreeing with them, even going so far as to keep a "secret" list of those they want banned, continually pinging moderators, and trying to goad those posters, by means of name-calling and ridicule, to retaliate with a bannable post.

The so-called birther "leaders," such as Orly Taitz, also indulge in rude, disrepectful and outrageous accusations against those who disagree, and allow of no dissent on their own blogs.

In short, the birthers, by denigrating others, have made themselves and their so-called "eligibility cause" into pariahs, not the other way around.

Exactly philman_36. Quoting the repealed 1790 Nationality Act was popular among Obots last Spring. Mario Apuzzo provided a reasonable rationale: legislators, knowing the redefinition of natural born citizen could not be achieved without an amendment - an act or statute cannot modify a constitutional provision - nevertheless passed the bill as a favor to pre-ratification diplomats who might have been on assignment, and have had children born overseas. Some of these were founding fathers. As philman_36 points out, it was repealed in 1795.

The 1790 act was also used by Tribe and Olson in their effort to argue for the natural born citizenship of McCain, since it was clear that Obama’s handlers really wanted to run against McCain; McCain's ineligibility would and probably did prevent any questions about eligibility being asked from McCain's; campaign.

Ericson has unfortunately shown that politics trump his desire to appear knowledgeable about The Constitution, as well as exposing his willingness to lie. He cannot not have known about the 1795 repeal of the Nationality Act.

How can Barack Obama Sr. qualify as a natural born citizen when one of his parents isn't even a US Citizen to begin with?

Well, it would be if only all the numbers matched. According to the U.S. Census Bureau there are only 1,314,241 people in all of Cuyahoga County of which 24% is under 18 and ineligible to vote. Yet they are showing a registration of 1,096,449 million voters? It turns out there are more voters registered in Cuyahoga County than actually exist.
