A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.
If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.
In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.
In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent defendants Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, were restored as plaintiffs.
But the judge did not immediately rule on Taitz' motion to be granted discovery – that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.

So what do you think? It looks like the soldiers and Keyes are deemed to have standing. I think Orly’s submission of birth certificates just as (un)reliable as Obama’s posted COLB is what has helped this case.
He just needs to submit the documentation requested and it will be over...unless it is not over.
Why would the Justice Department not just tell him to submit the requested documents and stop avoiding it? Do you think they know he’s not a natural born citizen and are defending him anyway? Is that against their oath to the Constitution?

I didn’t watch today, but I watched yesterday. He looked thin, gaunt, his lips were very blue and he kept rubbing his nose. He appeared desperate, on the verge or a meltdown. An angry meltdown. I think MO is livid and that’s why she didn’t attend the 9/11 ceremony.
I just want the truth. If the elite (Socialists, rinos, media, DNC, GOP...and all those judges who would not hear the case) are in cahoots to pull the wool over the public’s eyes so they could subvert the constitution on this, I want their heads! That would be worse than their usual level creepiness, disrespect and corruption.
That is good news. There is no reason to let Obama and his lawyers hide from presenting qualifying documents as requested by the soldiers and Keyes. Everyone else has to do it in order to attend public schools or Little Leauge! The State Department are big “birthers” when it comes time to get a passport! Obama is not above us and he’s not above the law.
The choice is a simple one: either demand that the current occupant of the Oval Office PROVE beyond any doubt that they are indeed qualified to hold that Office, or adopt the default position of holding down the body of our Republic while that Marxist fraud and his thugs continue to rape her.

No I agree - there's no smoking gun here.
But as you add more and more of the tidbits surrounding Mr. Obama's eligibility, such as the inconsistencies as to if he was born at Kapiolani vs Queens Medical Center (or elsewhere), his mother's location in Feb-Aug 1961, his Indonesian school records, etc, his statement today adds yet more mystery to the actual events surrounding his birth.

I don’t know what to think. When this Lucas Smith stuff started I called it BS. Now I’m not sure what to think. It’s been almost a year now and the research done is phenomenal, Freepers and others.
I have no doubt and I mean NONE, that he is hiding something, what, I don’t know. I lean toward a Canadian birth but won’t rule out a Kenyan birth. I highly doubt he was born in Hawaii, all evidence points to a birth elsewhere. There is no proof, NONE that his mother ever lived with his father. She enrolled in school in Seattle when Barry was a few weeks old. What mother leaves her new husband with her first baby? Why wouldn’t she go back to school in Hawaii where she met his father and where his father was attending? The stories don’t add up. He’s lying.
I will politely refer to Orly as our cousin Orly (as in my cousin vinnie) inexperienced, at times scary, but fortunately evidence ruled the day.
I can’t help but wonder if one reason Judge Carter made her accept Atty Kreep was to help her not hinder her.
I do hope someone sits her down and talks to her as she:
1) needs to know what the proper procedures are
2) Needs to follow them and quit talking when she is not supposed to talk and remember the judge runs the court
3) assemble a plan of attack
4) get help in the discovery phase from experienced investigators
5) Slow down and use her training and intelligence more and her emotions less
6) keep up the good fight!
I would SERIOUSLY rethink your post. Judge Carter was a Marine infantry platoon leader in Vietnam and is an HONORABLE man. I know a good number of the Marines who served with him and they are unanimous in that opinion. I also met him about 11 years ago at the funeral of a mutual friend, another Vietnam Marine. Your insinuation is a totally unjustified smear on a good man and you can correct that with a heartfelt apology and a retraction. Otherwise, we can escalate, as some of his Marines ARE here on FR. That was a MOST unwise statement for you to make.

Agree. I was addressing ONLY the idea that the speech sentence was some Freudian slip, like when he admitted to Steponallofus that he was a Muslim. There is no slip here, but I still suspect his citizenship.

Well, when you think about the idea that Stanley Ann went to Kenya with the father of her child and discovered his many other wives, I am not surprised she did not live with him when they returned from Kenya to the US.
I am not sold on the idea she gave birth in Canada rather Kenya seems more likely to me. That is assuming she actually married Barry’s father. Heck, we don’t know anything about the idiot.

There are some pictures that look like her, nudie pics. I wouldn’t swear they are her. Have you seen them? I think Canada is highly likely and the things the investigators have found(I won’t give it away here on the open forum) make Canada a real possibility but I won’t rule out Kenya. I have ruled out Hawaii.
Isn’t it odd that at the exact time Frank Marshall Davis’s wife moved out, and they got a divorce, Ann sent Barry back to Hawaii, her first born child, to live with granny and hang out with Frank. Think about that.

Your second point may well be moot since the documents have since been filed and accepted.
Early discovery “temporarily” denied! Till the MTD is accepted or denied. This has to follow a logical sequence and Judge Carter is not going to allow instrusion into evidence till it becomes a legal option or necessity. The need would disappear if he decides to dismiss the case.
Why open a can of worms like this
