If Obamacare is passed, can it be stopped? (Vanity)

Posted on 08/13/2009 8:19:06 AM PDT by wingsof liberty

Fellow Freepers- I think we have all been inspired by the outpouring of support at Democratic Townhalls in opposition to Obamacare. Even Independents are now turning against it, thanks to Democratic leaders saying its all orchestrated by Nazis, the KKK and that anyone who opposes it is "Un-American." And were not even halfway through August, so lets hope the momentum continues. Worst case scenario: Some think that The One will ram H.R. 3200 through no matter what. Many in Congress dont believe the opposition is real, and may vote it through with a simple majority, AKA "The nuclear option." This would likely be political suicide for them next November. My question is this: If it does become law, it will take years to implement. If we are successful in regaining majorities in The House and Senate next year, can the bill somehow be nullified or reversed? I have heard some Republican lawmakers state their desire to reallocate Porkulus funds that are not yet spent in this scenario. Would they have the same ability to reverse or change H.R. 3200, or will we be stuck with it?

They would have to insert a repeal of the bill into every piece of legislation that they pass and be willing to shut down the government for an indefinite period until Obama signs it or enough democrats come on board to override a veto.

Another good point. The GOP has said if this thing is rammed through via the nuclear option, they will go to war with the administration and bring all business brought to the floor to a halt. Lets hope they stick to their guns and dont all turn into RINOs. Again, I pray it doesnt come this. I will move to Texas whos reps have already said they will secede from the union.

Yup.

USSC.

I think the court will B-slap congress so fast it’ll make yur head spin. This is totally out of the bounds of Congress’s enumerated powers.

it depends on how quickly they could then drive the private insurers out of business. Probably not by fall of 2010, but we would need an awful big, decisive win at that point.

I beleive that there is a supreme court decision about one congress not being subject to another congress’s mistakes.

No. If it passes we’ll be stuck with it permanently or for at least a few generations. Look at the simple phone tax to pay for the Spanish-American War. That didn’t go away until what...2003? 2004?.

When the .gov creates anything it’s almost impossible to remove it.

I fear in order to remove any kind of .gov health care it will require an fdisk, format, and reinstall of the entire system.

It is pure nonsense to argue that once legislation is passed it cannot be repealed. There are numerous instances where that has happened. Prohibition comes to mind as an example.

The problem, however, is the RINOs. They are really demrats by a different name. They owe their allegiance to the Demrat Party. So, unless the RINO problem is neutralized, we are stuck with the abomination of gov’t managed (I use that term loosely) health care.

It can and will be reversed if we the American people put up a constitutional amendment that mandates all federal employees and elected officials must abide by and live with any law that they inflict on the public. They must be on universal health care, social security, term limits, ect... They may not opt out of ANY program, we need to take away their power and their benefits. They are servants, we are not slaves. Until we the American people bi&ch slap those arrogant self serving a@@es we get what we deserve. We also need to stop electing lawyers. I think that if they are a lawyer there out lets only elect CPA’s and economists from now on.

Too bad many of the 535 + 9 + 1 have the vaguest concept of either of those.

If it doesn’t increase THEIR power, most are not interested.

I specifically exempt Judges Thomas & Scalia from this statement. They seem to be the only men left on the court with any sense or remembrance of the US Constitution.

“Once this is passed, and a huge bureaucracy is put in place, it will never come out.”

Much of the bureaucracy and regulatory authority is already in place with the Center for Medicare and Medicaid Services (CMS).

An executive signing here, a friendly court decision there, and you can have all but the revenue portion put into place without legislation being passed. Stealth is a wonderful thing/ sarcasm.

It is also a near perfect solution to healthcare.

I think so, too...I think Mike Pence floated this and a couple of others that I have read, but they don't seem to want to antagonize the insurance companies (and/or brokers) by the inter-state trading...it gets short shrift, or so it seems, but it is the market spring that everything hinges on, IMHO...MD is a good example, where they have 3 choices, but if they could just go cross border to PA they could cut costs significantly...but if the US opened up completely, we'd have a VERY competitive market that would allow us to buy our own policies...portable and tougher to cancel or manipulate...(not that they wouldn't try)...

Even if we waved interstate sales, the savings would be profound.
