Breaking: Major has orders revoked, by questioning Obama's legitimacy

This story has been slipping under the Main Stream Media Radar for some time now.

U.S. Army Major Stefan Frederick Cook Filed a restraining order asking for legitimate confirmation that his Commander in Chief was legitimately in Office, giving him his orders to Deploy to Afghanistan with his unit.

Today in a stunning development, the Military rescinded those orders.

This has set a precedent heretofore unknown. The entire US Military can now not only question it's orders, a requirement of their duty when they believe that an order is given illegitimately, but can expect that their orders will also be rescinded should they question the legitimacy of the CIC who is the ultimate Authority in Command. In other words, Obama.

Biden was not selected by Obama. Biden was selected by the Electoral College. The Electoral College was overwhelmingly Democrat liberal.

You can't ask for TRO, which is relief from an action if that action is no longer material or relevant. The Army revoked the orders. There's nothing to ask for relief from. The motion will effectively be quashed, even if the Army directly moves for that, or not.

I know people like to see grand conspiracies in everything related to this administration, but this isn't one of them. This is just the Department of the Army dispatching a problem in the most judiciously practical way possible. In this case, a volunteer asked to be deployed, then he filed a TRO to not be deployed. So, the Army to save time and money in Federal Court, retracted the orders. It's not a conspiracy, it just the Army bureaucracy at work.

Now every officer is talking. Cook was right - every officer, especially the General Officers, open themselves up to charges of war crimes.

If you don’t think its serious, you can google up the stories on BHO’s administration going after CIA interrogators for following what they believed to be legal at that time.

The onus is on the OFFICER to determine the legality of their orders. That was the gist of the Lt. Calley v. United States of America case.

Either the Major is going to be a major for life, without being assigned orders, and without being discharged (those are orders too, and to accept those would be opening yourself up to dereliction charges), or some other officer under orders is going to refuse their orders.

This is about as NOT GOOD as it can get.

As of this evening, there is more than ample reason for every officer in the US military to suspect that orders from their command authority are no longer legal.

This may be a very interesting week.

I understand your diplomacy. I spent many moons with AF, Army and Navy during the 80’s and 90’s to get it right. I have never seen this kind of usurper action and that current CIC refuses to let HI. release his supposed BC. I know bull when I see it. I see it. Major Cook is right.

Ya right, The army generally lets their officers decide what orders they want to follow and which ones they can ignore. Kinda defeats the whole purpose of giving orders doesn't it? Your post is the dumbest post I have ever read.

The Army, upon receiving the restraining order, couldn’t wait to pull the Major’s heart out through his rectum.

This is a slam dunk case for the Army’s lawyer - satisfy the Major’s requirement that the order’s came from a legitimate NCA, and then decide whether to put the Major on a plane, or in the brig.

Army’s lawyer calls the Pentagon’s liason to the WH, and requests that BHO provide his birth certificate. Fax it, scan it, messenger a notorized copy from HI to the Army base in HI, and set up a conference call with that base’s legal officer, and the case is over. Four hours total, two days tops, to clear this thing and then ensure that the Major retires a Major, or perhaps something lower.

Army’s lawyer gets the following in response:

Rescind the order.

Army’s lawyer is probably speechless, wondering what to say to something like that, because the ramifications of that are nothing less than:

“If I just heard the WH correctly, no officer holding a commission will be expected to follow any order by force of UCMJ, because if they won’t prosecute the Major, and respond instead to rescinding his order, then it means any officer who pulls this stunt can expect the same treatment.”

Now the Army lawyer is starting to feel a bit dizzy, knowing that there are ballistic missile submarines and missile silos - all commanded by officers - who will now either follow or not follow their orders - anybody’s guess on whether they will or won’t, because if they don’t on these grounds, they Pentagon will RESCIND the order.

All of this to say the following chilling thing:

There is no longer legitimate National Command Authority in the United States of America. If you refuse to follow a direct order, on the grounds of that order coming from an illegal CINC, then you go away scot free: order rescinded.

As of today, we now have a Constitutional crisis.

Major Cook wasn't the first active duty officer to file suit, and one retired Naval Commander has charged Obama with treason, to which a response would have required discovery. Commander Fitzpatrick's charge was ignored as well. The commander was attempting to force discovery. Being wrong would have sent him to federal prison. That is the courage of conviction! Thank you Major Cook and Commander Fitzpatrick.

Obama seems almost the perfect cypher candidate for a a media-dominated society: If he has a past it has been thoroughly scrubbed, and whatever is there is being protected by mainstream law firms. Preparing a candidate with some African genes was clever politically. I still can't figure why Obama’s supporters (I'm betting on Soros) would select him given his claim (I say claim, because no one will reveal the legally declared name of his father; his grandmother was never interview able, and died within days of his election; and his great aunt's claim of observing the Kenyan birth is now denied) that his father was a British-Kenyan national. I suspect there is some sort of certification of Hawaiian birth which will simply cloud the real issue, that Obama is not a native-natural-born, or indigene citizen - his father was never a citizen.

Read the Supreme Court decision called “The Venus”, by Chief Justice John Marshall in 1816. There is a perfectly clear “definition” of exactly who is a natural born citizen, and where the court and the founders, Franklin, Jefferson, Washington, Marshall ...got the definition.

Another retired military officer, Charles Kerchner, has driven a remarkable lawsuit into federal court, with a very experienced immigration attorney, Mario Apuzzo, working pro-bono. I believe the military, with officers sworn to defend the constitution, and with their soldier's lives at risk, are protecting our society. I have learned more about how our representative republic was intended to work from reading the Apuzzo site (with Donofrio’s a close second), thanks both to Kerchner and Apuzzo, but also to the remarkable number of constitutional scholars contributing their research http://apuzo1.blogspot.com .

Whether Dr. Taitz, Kirchner-Apuzzo, Berg, or any other patriot forces discovery isn't important. Taitz is a tireless and fearless campaigner, and has another case in which the judge, a retired Marine Officer, promised last Monday that the case will be heard on the merits.

About the cypher president: someone on FR has posted the FrontPageMag article by Ben Johnson, "Obama's Biggest Radical" It is about John Holdren, Obama's Science Advisor, and explains who Obama is better than anything I've seen. In 2006 Holdren proposed reducing the "GDP per person ... to reduce greenhouse gases". Holdren wants a UN-controlled army and IRS.

Forget the rumors and concentrate on the law. It does, as Danae said, appear that the snowball is rolling.

This definitely bears repeating:

In short, officers will not be punished by the UCMJ if they question the Constitutional authority of Obama's right to hold office.

What do you suppose is going on behind closed doors? Are Army lawyers taking this as seriously as they should? How can this be effectively buried without other officers beginning to ask qestions- not just about the legitimacy of the CINC -but about the application of the UCMJ?

This is unsettling as hell.
