Door slams on Hawaiian hospital records

A door has been slammed on the hunt for confirmation of President Obama's birth in Hawaiian hospital records, with officials at two prominent Honolulu facilities either declining to return WND telephone calls or refusing to comment.
Kapiolani Medical Center for Women and Children and Queen's Medical Centerboth have been cited by various sources including Obama's half-sister as the birth place in 1961 of Barack Obama.
But officials at Kapiolani today declined to return any of at least four WND messages requesting a comment on what perhaps would be the facility's most significant claim to fame, and officials at Queen's said in a prepared statement, "Due to patient privacy laws we cannot respond to your inquiries."
They said that statement could be attributed only to a hospital "spokesperson."

Hospitals arent just going to turn private records over to anybody who waltzes in. There is an essential difference between obtaining medical records, and answering the question, "Was Mr. X born in your hospital", or "Was Mrs. X ever a patient in your hospital?"

The federal, and probably Hawaiian state law clearly protects the patients immutable right to privacy. Immutable right to privacy my Dear Aunt Sally. They publish birth records, the bare facts of "Mr and Mrs X had a baby boy in Hospital Z on .. " in the FReaking newspaper. Now it so happens that in '61 Hawaii didn't release the hospital name, but they did release the fact of the birth, the parents names, and their address. My hometown paper adds the name of the hospital.
Here's one from June 5, 2009:
Thai, Yen, and Nguyen, Thien, Lincoln, girl, Saint Elizabeth.
St. Elizabeth is the name of the hospital. There are two now, there were four.
So there is no federal law against releasing that much information. They just won't do it for the The Messiah. Why not?

The hospital is required by law to report births and deaths to the county registrar. The newspapers have junior reporters that go to the court house and read the daily register.
There is a Federal Law (and there is surely Hawaiian state law as well) that prohibits, or severely restricts a hospital's ability to release patient information.
You're entitled to your own opinions, but not your own facts.

In 1961 Kapiolani Clinic for Women and Children was just that....a clinic. Kapiolani hospital wasn't opened until the early '70s. There are no records since there was no hospital at the time.
It's hard to follow all the brouhaha over Obama's beginnings since no hard evidence exists.
The hospitals in Honolulu open for business were Queens, Kaiser (maybe), Leahi (for tuberculosis), Shafter (military), Straub (maybe again...probably a clinic), Castle on the windward side and Shriner's for kids with birth defects.
Consider that the hospitals in Honolulu have been barraged for information on our Feckless Leader, have replied negatively since there is no record of birth in their files and are losing patience with those that search for non existent records. This should not be deemed a cover up. It ought to be deemed fact.
Obama wasn't delivered at any Honolulu hospital.

I was taught (back in the Ice Age) in school that a person eligible for the Presidency had to be natural born: a child of American citizen parents, born on American soil. I think I wondered (when I first heard that) why anyone would dream of even running for the office if he didn't first meet those qualifications.
So now that brings us to BO and his time in HI. I have gathered from your posts that you know a great deal. You are stating categorically that you know for sure he wasn't born there: not in Honolulu, not anywhere else in the Islands, either?

Calling all HIPAA EXPERTS: After reading the article, I decided to see if there are loopholes that might allow for legal access to some part of the records.

C. Limited Data Set: Option for Research, Operations, and Public Health
The final Privacy Rule (August 2002) introduced a new category of information that may be used by an entity or disclosed externally without triggering all of the rule's requirements. This option is available only for research, health care operations, and public health purposes. DHHS requires many “direct” identifiers to be removed, but certain information - such as dates and geographic information without street address - may be retained. Whoever receives the information must agree to a “data use agreement” that describes the permitted uses and disclosures of the information received and prohibits any attempt to reidentify or contact the individuals. Of note, the data use agreement has fewer requirements than a business associate agreement.
Accordingly, researchers who remove most direct identifiers but need to retain dates (e.g., date of birth, admission and discharge date) and some geographic information may do so without triggering all of the Privacy Rule requirements. The “minimum necessary” standard (described below) still applies, but the requirement of accounting for all disclosures of PHI does not apply (also described below).
SO, if I'm reading this right, for legitimate research purposes, "date of birth, admission and discharge date" CAN be released without triggering HIPAA Privacy Rules.

I haven't a clue where Barry was born. Those that know are dead....or somewhere beyond the jurisdiction of investigating agencies, which You must have very reliable sources. now controls.
By reckoning he spent 9 or 10 years in Hawaii. Maybe more if he went to kindergarten here but the rest was when he went to Punahou where he excelled in loafing, basketball and drugs.
From what's been gleaned from the Coco Nut Wireless, he wasn't a star student or athlete, wasn't well liked, he was aloof and self centered and condescending to those around him. Some have publicly gained face time or print claiming to have known him while at Puanhou but they're few. Most don't remember him well other than his extra curricular enterprise and snotty attitude. Over here it's called 'high maka maka' or superiority.

Not really. Anything found is hearsay. The people I've talked to are ambivalent or just scared.
As far as the Natural Born Citizen argument goes, Barry himself has stated his father was a Kenyan, not an American citizen, nor was his step father Lolo Soetoro (an Indonesian citizen), and this is in writing in his pseudo autobiography. A Natural Born Citizen is born to American citizens in the United States of America....and not in a chapter of a fictional book.
