Constitutional crisis looming over Obama's birth location

The California secretary of state should refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until President-elect Barack Obama verifies his eligibility to hold the office, alleges a California court petition filed on behalf of former presidential candidate Alan Keyes and others.

The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama's status as a "natural-born citizen," a requirement set by the U.S. Constitution.

WND senior reporter Jerome Corsi even traveled to Kenya and Hawaii prior to the election to investigate issues surrounding Obama's birth. But his research and discoveries only raised more questions.

The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn't ordered it made available to settle the rumors.

The grandfather clause for people would mean Obama would have to be about 300 years old to be grandfathered in.

The Framers were VERY specific because they were concerned England might run an agent and buy the presidency like ahh...what just happened. Remember that England though beaten after the Revolutionary War was still a major threat.

The fact Obi was a British citizen at birth means he is not eligble. Obama admits it. Someone did not do their homework on the Obiu side and Leo did his homework.

Wonder if we have a Senator and Representative who values our Constitution and our country enough to call for a hearing if it gets to that point? I think we could count on Rep. Duncan Hunter, and Senator Inhof. Other than that I would have to think on it.

I read yesterday that Leo Donafrio was to give another interview this evening. Can’t seem to get on his web site now to see again who it was with. If I remember correctly it is to be at 8:00PM this evening. Anyone know?

Yeah, I've heard Leo's argument about McCain. I personally think McCain might be eligible as a Natural Born Citizen with additional law clarifying his situation.

But Obama's situation is more of a "clean kill."

I doubt if the Electoral College route will work. Obama’s electors are chosen for their dedication and loyalty to Barack Obama.
I agree with you that it will be interesting to see if any Senators or Representatives challenge Obama’s eligibility before or during the Joint Session of Congress to certify the Electoral College vote.
As to what the Supreme Court will do, that’s always anybody’s guess. They get about 8,000 petititons for Writs of Certiorari a year and they accept about 20-25 cases a year.
After Gore v Bush, I personally can’t see them getting involved in another election: EVER!

I understand the loyalty the EC Delegates have to cast their vote. But does the EC have any "investigative" powers?

Restated: Ultimately, is the delegates' loyalty to vote per the rules of their state, or is their loyalty to the US Constitution?

I think he was on Stang’s show at 8 am today - link also there on Leo’s site. Maybe 8 pm but it is says 8 am today. It was 8 am - I just checked.

Lan Lamphere had Berg on and I was not impressed with Lan. Leo’s has no axe because he is paying for this out of his pocket.

We have to get Leo on Savage, Levin, Rush, Hannity, and others but I doubt they have the guts now.

They have grave Constitutional issues, drama, intrigue, and involve the Founding Fathers’ concept of “original intent”.

I think Savage might. Everyone else is afraid to rock the boat for fear of the Fairness Doctrine.

The Fairness Doctrine would put the deathnail in this nation's MSM, and push citizens to shift to new alternative media.

I can hardly wait for the NYT to become a penny stock. We can do a Freep-a-thon to take a collection, buy them out and close them down. :)

It does? The Constitution states:

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

The term "natural born citizen" is not defined, so you have to look to how they understood the term. They, and the common law, understood that persons born of a father living outside the country in question, the US, was a natural born citizen. The law was changed to put some stipulations on that, such as if only one parent was a US Citizen, or sometimes both, he/she or both as appropriate had to meet certain residency requirements, just as the Constitution does even for natural born citizens to be eligible to be President.

McCain was born of two US Citizens, he is definitely a natural born citizen. Remember that citizenship by being born in the US was only instituted after the Civil War, with the 14th Amendment. Before that it was pure common law, which recognized, as does the 14th amendment, that the children of temporary resident expatriate from other countries would not be natural born US Citizens, in spite of being born in the US (Ambassadors, attaches, etc.). Since Congress has the power to "To establish an uniform Rule of Naturalization" and to "To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof." It is assumed that Congress can make laws concerning citizenship at birth. If that is true, the laws they made make McCain a natural born citizen, and Obama not, if the later was not born in the US.

You also have to look at the reason for the "natural born citizen requirement" in the first place. It was to be certain that there would be no undue foreign government pressure on the President, no "foreign family entanglements" as it were. Obama has those up the gazoo! Including a first cousin who is the PM of Kenya, at least according to the PM himself, who claims that his mother and BHO Sr were half siblings, that is that Odinga, the PM, and Obama share a grandfather.

I am concerned that we will have the Fairness Doctrince then web sites will be hit. The lady who runs Atlas Shrugs 2000 blog is getting threatening instant messages from OBots just like GOP lawyers got on election day from Dem laywers at precincts. Google is buddies with O and could cause a lot of web porblems or their stooges.

Web sites like FR could get banned. FR is getting hit daily by attacks to shut it down.

Leo’s case may be the last chance to save the Republic.
