Obama is "NOT" qualified to be President of the United States Lawsuit Against Obama Dismissed from Philadelphia Federal Court

(Lafayette Hill, Pennsylvania – 10/25/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court. The case is Berg v. Obama, No. 08-cv-04083.
Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court.
This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?
So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned.
According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

We must legally prevent Obama, the unqualified candidate, from taking the Office of the Presidency of the United States,” Berg said.

The Judges, attorneys will side step this with their Mumbo Jumbo frases that gets your head spinning, saying "that's the law, stupid" including some wise cracks here too!!!

I just hope those revolutionaries aren't a bunch of socialists who are “seeking safety and happiness” in a totalitarian regime or the next government may be even worse.
I think states will begin to debate whether they can stay in a union that has deviated so far from founding principles. Those who believe in the original premise of the Constitution should be free to reorganize around those sacred principles. The trick will be getting out alive. They want us to pay for all of this socialism.

I think the only people with standing are McCain, Ron Paul, Bob Barr, and Nader. i think you could probably add the RNC to the mix.Other than that the state officials tasked by state law or constitutions with actually running the elections. Berg is none of these.
Obama could have resolved this issue with the release of his BC from day one. If he is a legitimate citizen of the United States, he still can.
How did Judge Barlow rule in the New Jersey decision about Barry Goldwater being a natural-born citizen in 1964? That suit had standing and was decided was it not?
SCOTUS may not take it over the Circuit Court. If they do, expect them to put it to rest by agree with the District Court that there is no standing..
The overlooked thing here is that Berg, who has supposedly had this information for months, did nothing (or so it seems) to get a party that HAS standing to file this thing. He seems more interested in grandstanding than doing the best to get to the bottom of it all in a manner best designed to succeed.
Yes, that has been my opinion, too, since they are the ones who vote directly to elect the president.
Berg will file his case, not sure who will get it first, but given the seriousness of the matter it may go to the full court real quick. If they decide to hear it.... I am not sure... One would hope that it would be very very fast as in the 2000 decisions that stopped the endless recounts. I pray before the election. The closer it gets to Nov 4, the worse its gonna be.

I would have to prove who I am in qualifying for a job, damn straight it should be a standard for POTUS! Really its been left to the parties to vet their candidate, but the DNC utterly failed to do that and then knowingly covered it up. Democrats should be rightfully pissed off with their leaders.
Is not the decision in the Goldwater cases precedents? Not all of them were tossed out for lack of standing (were any?). They were decided on the merits of the cases -- whether or not Arizona territory (not yet a state) counted for natual-born citizen status.
I really don’t think scotus wants to come anywhere close to touching this now, 9 days before the election.
It is up to Obama to prove he has standing to be President. It is not up to Berg to prove Obama doesn’t have standing.
