Dear Jeff Head,

If you're born a citizen, then you're a natural born citizen.

To be a “naturalized” citizen, one must first be a citizen of another country, and that citizenship must precede American citizenship. But that can't happen to folks whose citizenship inheres at birth.

Thus, folks born on American soil are natural born citizens (with the previously-noted exception).

In fact, the purpose of the rules that you cite are to give the same status to persons not born on American soil as that which inheres to persons born on American soil.

The rules to which you're referring apply to folks born OUTSIDE the US, and permit folks not born on US soil to be called natural born citizens.

“This leads to an interesting series of questions. As age and citizenship are both constitutional requirements to become president it is not unreasonable to ask a candidate to prove their age or citizenship through a birth certificate or passport. It is not necessary for such documentation to be placed in the public domain where everyone has access to it, but to whom must they supply this proof? I am making the assumption that such proof was required in the applications to get the candidates name on the ballots in each state. Is that wrong”

Good points.

Now, why not this scenario:

The scene is one of the debates, or “town meetings” if Obama consents to them (I’m wondering if he’ll even agree to traditional “debates”, being so bad off-prompter).

At the appropriate moment, John McCain reaches into a pocket and pulls out a piece of paper.

He says to the cameras, “Here is my birth certificate. The real thing. Mr. Obama, where is YOUR birth certificate? Why won’t you let us see it? What does it SAY on it? Americans have a RIGHT to know!”

What next?

- John

His election as president would be the greatest coup any enemy has ever scored against this country and could easily lead to the worst, horrific disaster in our nation's history.

IOW, he is an America-hating poser who (in the judgment of many) intends to dismantle our Republic.

By all means, let's look into this birth certificate issue

There is absolutely no reason to keep such a harmless document from the public domain, UNLESS THERE IS SOMETHING TO HIDE!

For what it's worth: Wikipedia's take:

In fact, the phrase "natural born Citizen" is not defined anywhere in the Constitution itself and its interpretation has never been the subject of a U.S. Supreme Court ruling. Thus, some argue that even those born abroad to US citizens are not eligible to ascend to the Presidency, since an act of the United States Congress such as the Naturalization Act may not overrule the Constitution (see "Natural born citizen" as presidential qualification). Thus far, presidential candidates George W. Romney (born in Mexico), and Barry Goldwater and John McCain (born in U.S. territories), were never seriously challenged on the basis of their "natural-born" citizenship, but no candidate falling under this classification has ever actually become President, and therefore the question must be regarded as not having been finally decided.

(Yes, to leftists who can't read or think without liberal judges telling them what it means).

Why won`t Barack Obama release his birth certificate?

Perhaps because he doesn't want the world to know the truth about his father. (Obama senior was a bigamist. He was still married to a woman in Africa when he wed Barack's mommy in the U.S.)

From Wikipedia:

"On February 2, 1961, Obama Sr. married a fellow student, Ann Dunham in Maui, Hawaii.[10] She did not know that he already had a wife in Kenya.[5] Their son, Barack Obama, Jr., was born on August 4, 1961."

Ann Dunham Obama was 18 when Barack was born, and it is possible that the child was conceived when his mom was only 17.

Good thing they weren't living on an FLDS ranch in Texas . . .

Regardless of anything else that has been used against Obama up to this point, if the law is correctly stated, and if the facts and circumstances are shown to be true, this is political dynamite of the highest and most explosive order.

No wonder they’re trying to keep things under wraps. Perhaps there is some snippet of information on the mysterious birth certificate that disclaims citizenship, or could be implied to do that.

Ah, nope.

The Panama Canal Zone was not “US soil” and it never had that status.

I live here in Panama and we still crack up at all the misinformation regarding this subject.

The Panama Canal Zone had special status. Federal laws changed over the years but for McCain, at the time of his birth, had to have at least one of his parents be a US citizen and born within the Zone in order to considered a US citizen. Note that there is no special asterisk next to that designation. No “naturalized” or anything else. Period. Game, set, and match.

Look, bottom line is that McCain’s parents were US citizens. He is a US Citizen, i.e. natural born.

Military installations are normally leased from the host country and not considered “US Soil”. Embassies are considered “Sovereign US Territory”.

Wouldn’t candidates have to produce when filing for office? You need it for passports etc - anything Americans want to know should be given however-he is running for highest office so everything should out on the table

It's fair to ask this question of obama. (provide his birth certificate)
How many times did they question McCain about whether or not he was legally allowed to run for the Presidency?
If McCain has had to prove his standing, so should obama.

Whether it's where he was actually born, or if he ever 'really' registered when required to for selective service, it's a legitimate concern.

From what I understand, my son born outside the USA cannot run for President, nor can he pass US Citizenship on to his children if they too are born outside the USA.

Your son is a natural born citizen as long as both parents are U.S. citizens.

Citizenship of Children

The 14th Amendment of the U.S. Constitution guarantees citizenship at birth to almost all individuals born in the United States or in U.S. jurisdictions, according to the principle of jus soli. Certain individuals born in the United States, such as children of foreign heads of state or children of foreign diplomats, do not obtain U.S. citizenship under jus soli.

Certain individuals born outside of the United States are born citizens because of their parents, according to the principle of jus sanguinis (which holds that the country of citizenship of a child is the same as that of his / her parents). The U.S. Congress is responsible for enacting laws that determine how citizenship is conveyed by a U.S. citizen parent or parents according to the principle of jus sanguinis. These laws are contained in the Immigration and Nationality Act.

In addition, Each year, many people adopt children from outside the U.S. The Child Citizenship Act of 2000 (CCA) grants those children the ability to automatically become U.S. citizens when they immigrate to the United States.

“Obama’s mother was 18 when she had him, and had been living in Kenya. Therefore, he may not have qualified because of her whereabouts in the five years before his birth.

A technicality for sure...but may be a part of the law. And that is a law the founders put in place to protect America from exactly (IMHO) this kind of candidate.

That’s because Barack Hussein Obama is the apex of the hate-America, domestic enemy in this country. His election as president would be the greatest coup any enemy has ever scored against this country and could easily lead to the worst, horrific disaster in our nation’s history.”

Fine post, Jeff.

THIS is the bombshell that has the power to sink Obama’s ship.

Has Rush gotten ahold of this information yet?

This MUST get the widest dissemination possible. The mainstream media WILL NOT TOUCH this until they have no other choice.

Whether by technicality or not, Obama is not Constitutionally qualifed to become president of the United States.

Playing devil’s advocate:
If he does escape this, and gets elected, could he at some point be removed from office for the same reason? By Congress? Or by a “Seven Days In May” scenario?

Dangerous question to ask because McCain was born in the Panama Canal Zone.

Great point. Let's chuck 'em both and start over again with two new candidates.

“birth records are a public document. Go find them.”

Exactly.

Unless those records have disappeared, or been doctored.

Somebody on our side better get onto this, QUICKLY. I have a feeling that those “records” aren’t going to remain visible or UN-doctored for long.

I’m beginning to wonder if Obama was indeed born in Hawaii. Could the birth have actually occured OFF United States soil, and then mother and newborn flown to Hawaii shortly afterwards, and some kind of “amended birth certificate” been obtained?

Seems to me that - if everthing was kosher - that Obama would be eager to get this information out, to dispel any rumors.

Something is whispering in my ear that things _ain’t_ kosher here.

Were you married to an American citizen at the time?

No, and my wife has never become a citizen. She is an EU citizen and does not want a green card nor US passport.

Thanks all for the answers... so far, this question is academic for me as my son is not about to Run against the Obamessiah - he's still a teenager.

The articles I’ve read state that Hawaii will not release these records. I don’t think they can be obtained very easily, or I am sure that someone would have gotten them by now.

Barack Obama’s father was not a U.S. Citizen and Obama’s mother was only 18 when Obama was born, which means though she had been a U.S. Citizen for 10 years, (or citizen perhaps because of Hawai’i being a territory) the mother fails the test for being so for at least 5 years **prior to** Barack Obama’s birth, but *after* age 16.

One would have to check the law that made Hawaii a state, but I assume that everyone who was born there prior to it becoming a state did not have to go thru a naturalization process to be considered a US citizen. No naturalization required, then the only alternative is to be considered natural born.

Barry Goldwater had something similar because he was born in AZ before it became a state.
