Well it is a conservative website (Not GOP) which puts John McCain in the line of fire too.

Dear Jeff Head,

The law to which you refer is only to be applied for folks born to an American parent OUTSIDE the United States.

Persons born in the United States are natural born citizens, EVEN IF their parents are not US citizens. This is the problem with the whole “anchor baby” thing with illegal immigrants.

The exception would be children born to foreign diplomatic personnel, who are, by treaty, immune to prosecution under our laws, in other words, not subject to our laws.

My brother was a missionary in the 50s. The family had to come back to the US every 5 yrs. to renew their citizenship. Or perhaps it was because his wife was naturalized, I don't know.

The reason your argument doesn’t hold is that he was born in the USA, not abroad. All those rules are for children born abroad. Hawaii was given statehood in 1959. Barry was born in 1961. Therefore he is a citizen twice over: under current interpretation, merely by location of birth, and by all other intrepretations by the fact of having been born in the USA to a citizen mother. That has always been “good enough” to get you American citizenship.

The only way this could play out would be if he was actually born two years earlier (prior to statehood) (very unlikely, who lies about their birthday their whole life), or was not born in the USA but somewhere else. (also totally unlikely)

If he was born in America to an American mother, you’re gonna have a very tough time getting him disqualified (even if nuances of law indicate he should be).

As regards to citizenship, I agree completely. But as regards to natural born citizenship I differ. The distinction only makes a difference when running for President.

In Obama's case, at the time of his birth, US law held that a natural-born US citizen had to either have both parents be US citizens with one having been in the US for a year before the child's birth, or if only one is a US citizen, then that parent must have been at least 16, and in the US for ten years total, and five years before the baby's birth.

In Obama's case, his mother was only 18 at the time of birth and had bene living in Kenya before the birth.

This is the issue, and whether or not it entitles him to natural-born citizenship as oppsoed to naturalized citizenship makes a difference. I am not entirely sure which way it falls...but I believe his case is much more questionable than McCain who was born of two natural born US citizens and therefore became a natural born citizen as a result.

Needs more research...but it is such a technicality that in today's environment it will be difficult to argue.

A child of an American is a natural American.

Not in all cases, for those born abroad. For instance the children of Vietnamese Woman and American Soldiers from the Vietnam War Era are not natural US citizens. The law has changed several times. So it depends on circumstance and year of birth.

I agree he is a US citizen. But, having US citizenship and "natural-born" US citizenship may well be different, particularly at that time. I am not sure, but the distinction only makes a difference when running for President.

In the end, it is such a nuianse and technicality that it will most probably not be argued in today's environment.

Barry was born in Hawaii. He was therefore born IN THE UNITED STATES not abroad. His mother was a American Citizen. Kids with an American mamma AND born in USA are "Natural Citizens".
