Feds strike ID deal over NY licenses

The Bush administration and New York agreed Saturday on a compromise creating a more secure driver's license for U.S. citizens and allowing illegal immigrants to get a version.

New York is the fourth state to reach such an agreement, after Arizona, Vermont and Washington. The issue is pressing for border states, where new and tighter rules are soon to go into effect for crossings.

The deal comes about one month after New York Gov. Eliot Spitzer announced a plan whereby illegal immigrants with a valid foreign passport could obtain a license.

The agreement with the Homeland Security Department will create a three-tier license system in New York, the largest state to sign on so far to the government's post-Sept. 11 effort to make identification cards more secure.

Spitzer, who has faced much criticism on the issue, said the deal means New York "will usher in the most secure licensing system in the nation."

Homeland Security Secretary Michael Chertoff said he was not happy that New York intended to issue IDs to illegal immigrants. But he said there was nothing he could do to stop it.

"I don't endorse giving licenses to people who are not here legally, but federal law does allow states to make that choice," Chertoff said.

New York will produce one ID that will be as secure as a passport and is intended for people who soon will need to meet such requirements, even for a short drive to Canada.

A second version of the license will meet new federal standards of the Real ID Act, a law designed to make it much harder for illegal immigrants or would-be terrorists to obtain licenses.

Does this mean that the State of New York, the Department of Homeland Security, and the BATFE are making it easier for illegal aliens (read terrorists) to purchase their new AK-47s or AR-15s? Or is it a new way to circumvent the 2nd Amendment to make it even harder for a citizen to purchase a firearm?

I leave it to the conspiracy theorists to provide an answer.

If Spitzer were a Republican, and the subject something other than illegals, the left would be screaming facism and police state over those words. But now I suppose it is all moot, seeing how the Bush Administration has now (once again) spit in the citizens faces and cut a deal with Spitzer and the NY Dems. I previous commentor said something to the effect that unless the licenses for illegals have ILLEGAL stamped across them we are screwed...and I agree. The County Clerks are true hero’s, but before they were just fighting Sptzer, now they are fighting him and the Bush adminsitration. They have a lot more to be concerned about as far as being messed with.

The federal license ID law requires that any licenses issued to non-residents be a different color, and state on their face that they are issued to a non-resident. Therefore, these alien licenses would not meet the ATF conditions.

The way that Spitzer wanted to do it originally would have given illegal aliens the SAME license as New York citizens.

The clerks wouldn't be fighting the Bush administration, how do you figure that? The administration has no authority over issuing licenses to illegals, according to REAL ID that's up to the states. And under NY law, which takes precedence Spitzer hasn't got the right to hand out licenses to anyone without a SSN or proof of ineligibility. There's a lawsuit that's still on and another one coming regarding that. In addition you'll probably see the NYS Senate refuse to fund any scheme that provides licenses to illegal aliens.

In my opinion fwiw I think we're in a much better position now than before to put the kibosh to the whole thing since Spitzer has postponed his scheme until next year.

If the Bush White House thinks it is a good idea to give ilegals drivers licenses they are in a whole other position to punish anyone who works against it. The IRS audit is the first example of messing with someone that comes to mind. But I ceratainly hope you are right.

It's time for states not issuing phony IDs to phony "immigrants" to reverse reciprocity on NY IDs.

Actually, the Real ID law will require that no state issue a "valid" license in return for an "illegal" license from another state. If the reciprocal license laws depended on the intelligence of state legislatures and DMVs, several -- like California -- would be just as squishy as New York.

Five years ago in January, I told a meeting of state legislators meeting in Washington that if they did not get their collective acts together on the drivers license issue, the Congress would do it for them. Well, they didn't, and it did, exactly as I warned.

1.Spitzer attempts to bypass NY State legislature despite NYC being Target One by those who use our lax/bipolar policy against us.

2.Hillary Clinton needs the votes of illegal aliens who’d be processed under the motor/voter act ushered in by her husband.

3.Despite these actions and bad precedents the supposedly Republican Administration is backing a Democrat’s move to practically insure that the Republicans will be forever disenfranchised in a critical state.

Add to that this Administration’s foot-dragging on Southern border security when terrorists are definitely getting in via that route...let the prosecutions begin! I’ve been calling for a revival of a new Anti-American Activities Committee. So many traitors - so little time left to get a handle on them.

Spitzer’s side sounded a lot different than Chertoff’s side:

Gov. Eliot Spitzer said Sunday that his new plan to make it easier for illegal immigrants to get driver’s licenses while creating one of the most secure licenses in the nation is the result of conversations with an old friend, U.S. Homeland Security Secretary Michael Chertoff.

Spitzer said he has known Chertoff for more than 10 years, going back to Spitzer’s life as a prosecutor and before, when Chertoff’s wife went to Harvard Law School with Spitzer. Spitzer said long, collegial conversations with Chertoff over several weeks led to the change in policy.

See, that's what I don't get. New York Dems have a lock on their state. As in, Davy Jones's locker doesn't have the lock they do, on New York's electoral college votes.

So why this obvious, public chiseling of the nation's voting laws to pack a few polling places in NYC that were going to vote Socialist Workers' Party/Democratic/Green Party anyway?

Without addressing the balance of your point, this seems to be a good beginning at a description of a self-correcting problem.

If "Red-state" (i.e., Non-Pinko) America just goes limp on these security issues and does a rope-a-dope on the whole thing, letting Hillary and her vanguard Amazon girlpals do what they want for the next 10 years......

....our real security threat out in "flyover country" would seem to be limited to someday having to inhale the warm, and possibly radioactive, ashes of our formerly Democratic-voting fellow citizens. I mean, not to be fey or anything.... but we are not the Moonbats' worst enemies, despite their opinion of us.

Giuliani is from NY. That’s one reason.

Another reason is that it affects the overall national popular vote. Dems want the overall popular vote even if they don’t win via electoral college so they can claim they are being robbed etc.

A third reason dems would cheat on this is that is what dems do.
