One does not have to explicitly state CASE law to understand that the courts do, IN FACT, legislate from the bench.

I am glad I read the article, and followed some links. I joined FreeRepublic to learn more about what is happening to our country, (and meet some friendly aquaintences in the process.)

You post no mistake. The courts are, indeed, creating laws, from the bench. And it has become a very real problem, as laws are only supposed to be made by legislators...not judges. But as activist judges are not following the Constitution, they are, indeed MAKING LAWS.
