This move also gives cover to all of the people who long ago should have called for this whole thing to be dismissed and Nifong investigated, particularly AG Gonzales.

Except for the fact that the only ones who will be fooled are those who want to be fooled - which at this point ain't very many people.

Nifong's investigator interviewed the woman Thursday, and she told the investigator that she couldn't "testify with certainty" that she was raped.

The libs will now claim that "Whitey" intimidated her into not testifying, so this just "proves" that they really did rape her. They'll say this just proves that there is no justice for blacks in the system.

Nifong, of course, will do nothing to try and challenge this spin. He can play the "I tried to go after these rich white rapists, but the system didn't allow me to" card, and guarantee himself a lifetime sinecure as Durham's DA.

Nifong's investigator interviewed the woman Thursday, and she told the investigator that she couldn't "testify with certainty" that she was raped.

That's like saying, "Mr. Prosecutor, I can't testify with certainty that I have ever eaten food." Either you were, or you weren't, and it seems a little disingenuous to say, a year into the investigation, "whups, maybe it didn't really happen."

Her case might also have been hurt by giving birth, nine months after the supposed "rape", to a child that matches none of the DNA of the students accused, and allegedly having "contained" when examined for the supposed rape, five "DNA samples" that matched none of the students involved.

In keeping those ridiculous charges of sexual assault and kidnapping, Nifong is still trying to save face his sorry ass.

Unfortunately, this turns the case into a "he said she said" situation in which there is no objective evidence to refute her claims. This gives a Durham jury free license to believe whatever they want. This is a very dangerous development.

Ok, so he did the right thing and dismissed the rape charges. He's still a 4 star horse's backside for not dismissing all charges.

He didn't do the right thing--not even partially. There's no way in h*ll the rape charges could have met the minimum evidentiary standard to even go to the jury. This hateful s.o.b. has done what he needs to do to keep persecuting these students. What an evil hack.

Well, he needed to win re-election. I'm sure he figured around election time that he'd deal with all this around Christmas, which is exactly what he's doing.

I doubt it ... his constituents re-elected him to office knowing his flaws. It will be up to the players to seek justice in Federal court against the Fong and they will have to break through his soverign immunity protection claims.
