Breaking...
Update:
WASHINGTON The Supreme Court ruled Thursday that President Bush overstepped his authority in ordering military war crimes trials for Guantanamo Bay detainees, a rebuke to the administration and its aggressive anti-terror policies.
Justice John Paul Stevens wrote the opinion, which said the proposed trials were illegal under U.S. law and Geneva conventions.
The case focused on Salim Ahmed Hamdan, a Yemeni who worked as a body guard and driver for Usama bin Laden. Hamdan, 36, has spent four years in the U.S. prison at Guantanamo...

Why are irregulars who are not signatories to the Conventions even covered by them?
Justice Kennedy voted with the libs ...
Sickening.
Fine. Bush should order them stood against the wall and executed.
Please explain.
...but that seems to leave the door open for SCOTUS itself to define "active hostilities" and when they have ended, does it not??

In truth, the 'rats are more dangerous. The catastrophe of the Byzantine Empire in 1071 when they lost the battle of Manzikert to the Turks occurred because the other side of Byzantine politics abandoned the emperor on the battlefield.
The Turks won and captured most of the breadbasket of the Empire, plus its main source for soldiers.

So long as SCOTUS doesn't hold in the future that the GITMO detainees are entitled to due process in Americas courts this is the best of all worlds. The WOT isn't gonna end in their life times. And now they can be held for the duration without all the yapping about their day in court.
Of course, I'm dreaming. There may well be 5 votes on SCOTUS to usurp the CIC's war making authority. Sad but true.
Thank you, Ross Perot voters.
the Borking of Robert Bork...the gift that just keeps on giving!!!!
Works for ME !
What's truly indicative of where all the Lefties are (bash Bush), is that the immediate prefix to all the coverage is "in a MAJOR setback to President Bush". None of them are at all addressing the implications of the ruling, but just tout the "Bush loses" flavor that makes them roll on in orgasmic fits that SOMEHOW this is good for America????
What a bunch of treasonous a$$holes we have in this country on the Left.....

[if the GOP were smart (and I strongly suspect they are NOT this smart!) they would pick up this ball and run with it.
This is the golden jazz-up-the-base-for-November moment that they have been waiting for. After al, the SC just sided with OSAMA BIN LADEN'S DRIVER over POTUS and 60 yrs. of settled law!!! That is 30-second spot GOLD if ever I have heard it!]
BINGO. Bears repeating. Again, and again and again. This may be the impetus to reform the liberal courts including SCOTUS.
Actually, the issue as stated isn't taking them prisoner...it's trying prisoners via a system not put into law. Different issue. I presume the actual ruling is out there somewhere.
"Kennedy's opinion did not support all of Stevens' discussion of the Geneva Convention, but he did find that the commissions were not authorized by military law or that Convention."
Regardless, he is off the dinner list.
Exactly!!
On the other hand, this ruling will only generate more energy among conservatives to ensure that Repubs win in 2006/2008. Stevens and Ginsberg are being kept alive by machine and cannot stay on the Court much longer.
