OCALA, Fla. -- A Florida judge said a plea deal for a Tampa teacher accused of having sex with a 14-year-old would "erode public confidence in" schools.
Marion County Circuit Judge Hale Stencil has rejected the plea deal for Debra Lafave, 25. The judge said the deal would undermine the credibility of the criminal justice system.
Prosecutors and the defense lawyer had urged the judge to accept the deal for the good of the boy. A psychiatrist told the judge the boy suffered extreme anxiety because of intense media coverage of the case and does not want to testify.
Lafave was charged in two counties where she's accused of having sex with the student.
A judge in Hillsborough County accepted a plea deal there in November and sentenced Lafave to three years of house arrest and seven years' probation. She pleaded guilty in November to two counts of lewd and lascivious battery for having sex with the boy in a classroom and her home.
One other factor. Girls tend to fall in love while boys just want to have sex at that age. All of you who see no difference between the sexes need to open your eyes.
It is true, girls mature more quickly than boys, but no one is ready for a serious relationship at 14 or 15 and boys are less likely to fall into a serious relationship or have their emotions hurt.

Not that it will matter to those here who have unfulfilled teacher fantasies.
That's the difference. For a girl, she would regret for the rest of her life having had a fling with a teacher.
Not so for the boy in this case.
Why do you say that the boy is not the victim? What reason can be given to support the assumption that he will not feel undifferentiated regret or shame over this for the rest of his life? For example, is this something he would unhesitatingly disclose to a prospective bride? Is this something he will remember at his wedding day, assuming he gets married?

Didn't notice... my guess is that the prosecution wanted to drop on the same day the judge dismissed the plea so that the prosecution could clearly tie the two events together i.e. it was the judges fault, not ours.

They are always without prejudice unless jeopardy has attached. In most jurisdictions that's when opening statement is made.
My son, at the age of 14, will already have heard 1 Corinthians 6:9-10 read and preached on at least 10 times in the church he attends every single Sunday, as well as have been instructed thoroughly in Christian morality in preparation for his Confirmation.
Besides this formal instruction, he will have grown up in a household where mom and dad honor their marriage commitments and hold them to be a sacred and essential part of his home life.
If I actually have to take him aside at the age of 14 and explain to him that adultery is wrong and that married women are off limits then I've wasted 14 years of his life up to that point.

Unless he had morals, and later, when he got control of his hormones with a little age on him, he wanted to be a virgin for his wife. (There are plenty of such moral people out there.)

no. but my son? no big deal. more political correctness stupidity. boys and girls are different, mmmkay. boys want to hit on their cute teacher and really have little to lose by doing it. girls have lots to lose. it's in a boy's nature to want to do the thing with an attractive person of the opposite sex. it's a strong instinct, the get with the pretty woman instinct, you know. LOL.
Few 14 year olds could say no to that -- but that is also not the issue here. Debra LeFave is the one who had a duty to say "no," and she did not.
