Tom Guy let us know 2 facts about a senator who might be doing well today but otherwise would be outside our usual support. Personally I would rather deal in facts to know who these people are than a constant pep rally no matter the Republicans past record.

Sessions: If a general statute clearly contemplates certain actions and they can't be effective without those actions, than it wuold overrule the earlier statute.
Gonzales: General statute vs specific statute - this was raised in the Hamdi case. SCOTUS said that authorization to use military force was sufficient to overridge prohibition in 401(a).
Sessions: Hamdi case is pivotal here. Hamdi case - American citizen held without trial and SCOTUS upheld it. They ruled it was an incident with regard to authorization of force.

Feinstein announces, "I don't want to argue with you," and then goes right on to insist that of course the president would be tempted to suspend many civil liberties. Bad form, Senator. Rude and unjust. God forbid you should actually listen when Gonzales attempts to offer a reasoned answer to your outrageous, DailyKos-level question.
Feinstein asks him now if he's got any other secrets.

Sessions: Under FISA we are far more restrained in using our military than history has demonstrated. We're not going hob wild restraining American liberties and we're providing more and more protections and it can be a danger going too far and letting sleeper cells operate in this country.
President Clinton's administration ordered warrantless searches on Aldrich Ames. Also authorized warrantless searches of a Mississippi financier.
Jamie Gorelick said the president has inherent authority to conduct warrantless searches.
