Reid must have given him a pass because of his senility and allowed him to vote yes.
Oh here is the constitution book again..

I refuse to tow the party line when it comes the the SCOTUS.

Don't know how true it is (or just myth), but Byrd has always been touted as a man who holds the Constitution dear.
