the court, nor the congress, has any say in how the military treat it's prisoners of war.

If that's what the defense attorneys argue then it must be a good idea -- at least that's how the logic works with this writer.

How about we do what the Geneva Convention allows for in these cases? Hold a summary court martial in the area where they were captured. Either release there, or carry out the penalty prescribed the the G.C.
