A majority opinion in Shore Regional High School Board of Education v. P.S., 381 F.3d 194 (3d Cir. 2004), holding that a school district did not provide a high school student with a free and appropriate public education, as required by the Individuals with Disabilities Education Act, when it failed to protect the student from bullying by fellow students who taunted the student based on his lack of athleticism and his perceived sexual orientation.

I would be interested in knowing more about that one. Why was the school responsible? Was it verbal only? How did they define "bullying." Why does this apply to the Individuals with Disabilities Education Act? Is there something about sexual orientation in there? Were the kids just verbally disapproving, and this was interpreted as bullying? Would lack of athleticism been enough to acheive the same result? What happens when a kid is called "four eyes" a lot? If he was just applying the law, then fine. But there is potential danger here.

Has anyone found ANYTHING that would suggest that Alito is anything BUT a strict constructionist conservative Judge? Anything? It would be so deliciously sweet if he is just like Scalia and Thomas and Roberts. A firm four conservatives on the SC. With kennedy voting his convictions when he isn't concerned with the media's involvement in his legacy.

Now I hope and pray that stevens or ginsburg or BOTH **GIGGLE** step down and retire. How awesome would it be to have SIX firm conservative Justices on the SCOTUS??? That would be the most conservative SC since before FDR, I believe. We are witnessing something that took 60 years to do. This is a biy euphoric through the lense of history. 8)

Senator Specter said Judge Alito deserves "clear sailing". Michelle Malkin writes on her blog, "This is a nominee the Right can get behind." Last night on Drudge radio, Pat Buchanan said an Alito nomination would "vindicate my endorsement" of President Bush. Looks like all the bases are covered on this one. The President has struck gold with the Alito nomination.

I agree. I also half expect Coulter to come out and say he's not a "real" conservative.

Right on! The then upcoming Supreme Court vacancies, were the driving force behind tons of pro-2nd Amendment and Libertarian minded folks, giving the Republicans one more chance. The last two elections were all about the Supreme Court. It wasn't so much about abortion, either.

From what I can tell so far the media and some of the commentators are trying to upset the Women and Middle America by drumming up the Question Why not Harriet Miers?

Why Was she not good enough? They are trying to thump on the Super Conservatives as Elite bigots to HM.
