I totally agree, but it is an argument that the Democrats and the MSM are going to pound home to the people 24/7.

Yes, and the answer is as I laid out -"Who replaces who is an effort to maintain status quo. President Bush campaigned on a promise to nominate Justices in the mold of Thomas and Scalia, not on a promise to nominate judges in the mold of O'Connor."

I don't think this really matters anymore.

Rehnquist's position has been filled. END of story.

Now O'Connor's position is in the process of getting filled.

To say otherwise is to ignore objective reality.

Exactly. Thanks in helping to make this more clear to the others. What is important is the final ideological vote, not how the pieces were put in place. You and I know the Court really is not moving much. By focusing on this Alito/O'Connor falsehood, the liberals and the MSM make it look like it is a massive shift to the right. Just ain't so.

And I could say, don't be obtuse.

There were two openings at the same time. Roberts was originally picked to replace the moderate O'Conners. When the new opening came up, the stealth candidate Roberts was switched to replace the solid conservative Rhenquist.

The Democrats are having it both ways. They gladly let Roberts replace Rhenquist and never mention anything about the probable shift to the left and then they pick a fight because Alito is most likely to the Right of O'Conner.

It's not clear why you guys are looking so technically at the situation and avoiding the big picture.

Because generally when someone tries to read into whatever big picture they are looking for, they are WRONG with this President.

No it's not the end of story. The democrats are going to oppose Alito because they are claiming it will result in a huge shift to the right on the court. This is totally ignoring that the Roberts pick moved the court temporarily to the left.

Orin Hatch is already saying that this process will be "Armageddon". Do you really think that either Alito for Rhenquist or Roberts for O'Conner would have resulted in "Armageddon" on the senate floor? Harry Ried is already trying to delay the hearings until after the new year.

The bottom line is that Bush switched Roberts from O'Conner to Rhenquist so that he would have only 2 confirmations rather than 3. This unfortunately is going to make the Alito confirmation much more difficult.

Where did the tinfoil comment come from? This is no conspriracy theory - it's just good sense.

Bush horsetraded 3 confirmation hearings for 2 but made the mistake to give the democrats their horse first.

BTW, how did that Miers pick work out for "this president"? Oh, and how exactly is chumming up to Bill Clinton working out for "this president"?

Don't be naive and believe that Bush is playing chess while everyone else is playing checkers. He's made plenty of mistakes and was very close to becoming a lame duck if he had not pulled the Miers pick in time.

Geesh, in comparison to Rhenquist, almost anyone would move the court to the left. Rhenquist is probably the most solid conservative on the court due to his longevity.

Just pure common sense would show that the odds are that a stealth candidate like Roberts probably is not as conservative as Rhenquist was. Especially since Bush originally lined up Roberts for O'Conner's spot.

Why is that so hard to grasp? I'm not arguing some stupid conspiracy theory or communist plot. I'm just pointing out political realities.

Please read posts and understand them before commenting on them. I am not for maintaining the status quo on the court - I want it to move right.

I only pointed out that the democrats are going to use the fact that Alito is to the far right of O'Conner to try to destroy the nomination. They are already doing this, so it seems like you are the one living in fantasy land.

My point was that the democrats, the MSM and even many on the Right are ignoring that Roberts is most likely to the left of Rhenquist.

I read the posts. You want to argue that we're maintaining the balance.

The balance is crap. We should be railing against the activist court and crying out for judges who interpret the constitution as it is, not as the living document.

I don't know why I waste my time arguing with cranks.
