This is what is bothering me. If Libby testified on what he said to reporters, even if what he said to these reporters was false, how is that lying to the Grand Jury?

If Libby didn't tell the reporters the truth about what he knew at the time, how can he then tell the GJ that he told them the truth.

I am confused by all this.

It looks like Libby is being indicted because he gave permission to Russert, Cooper and Miller to screw him.

........Here, the prosecutor violated his duties by investigating the facts before determining whether there was a law that could have been violated even if the facts were true. He then set perjury traps for administration people, while being surrounded by liars who should have been charged with perjury--Miller, Wilson, Plame, Cooper and the whole lot of them.

Fitzgerald revealed himself as a partisan hack and this will stick with him for life. I can only hope that he gets creamed in court, and becomes a Ronnie Earle. Had he been a no-nonsense prosecutor, he would have never gotten to this, and then issued a report that simply said that no crime was committed. Had he been a milquetoast like Ken Starr, he would have released a report that simply said that one witness was incorrect on the facts, but he would never have charged him. What happened was that Fitzy went WAAAAY out of his way to get administration officials, even when there was no underlying crime, and NEVER COULD HAVE BEEN.

There's arguably some similarities, but the Clinton ultimately settled the sexual harassment case that he committed perjury while testifying in, so presumably the suit had at least some validity. Also the lawsuit wasn't brought by the government in the first place.

Speaking of Bill & Hill Clinton: Can we dust off these charges and find a friendly Republican prosecutor to file charges for the offenses you noted?

Almost all non-capital federal felonies are subject to a 5-year statute of limitations. (Tax evasion is the only exception I can think of-- it's 6 years.)

Hanoi Kerry was still a USNR officer while he:
gave false hearsay testimony to Congress
negotiated with the enemy
helped the US lose a war
abetted in the deaths of millions
created a hostile environment for all servicemen

Why is Kerry still in the US Senate?

Oh definately. But after reading the indictment, it looks like Russert is not really disputing the facts of the indictment. It turns out that Libby claimed under oath that Russert told him Plame was CIA when Russert said no such thing. Fitzgreald makes a case that Libby knew that she was CIA from other sources and knew before that telephone call. He's being indicted for claiming that Russert told him Plame's name, when in fact according to Russert, he did not.

You make many excellent points. However, I would strongly disagree with you that the MSM now has the weapons to destroy this administration. Only if "conservatives" do another Miers on him, then yes, Bush will be in trouble.

I also do not believe Bush's political capital is almost all spent. I think the media are intentionally misreading the whole Miers situation. Miers was NOT, by and large, cast off because she was a crony, because she did not have sufficient judicial experience. Miers was cast off solely because many in the base believed Miers was not conservative enough!

What the MSM typically omits from their constant recitation of Bush's poll numbers is that most every other modern day president has had worse poll numbers at some point in their administration. This is the normal ebb and flow.

For the last several weeks the media has desperately sought to portray the Bush administration as in deep weeds. They are not. And they are not by a long stretch.

Scooter Libby doesn't get to decide if a crime has been committed or not...he doesn't get to decide if it's okay to commit perjury because he really didn't commit a crime in outing Plame. A judge or jury gets to decide if a crime was committed.

And FWIW - there's much discussion on this board about whether Plame was covert or not. I guess the jury is still out on this (pun intended). But Scooter Libby doesn't get to decide if it's okay to out even a potential CIA agent. As someone with top secret clearance he was well aware of the responsibility that comes with such trust.

If Libby & Rove were so convinced that it was okay to mention Plame's name to the press...why did they act so secretively about it? Why did they refuse to admit that they were the sources? Why did Libby ask Miller to misidentify him as a former hill staffer? Why did Matt Cooper have this info on 'super double secret background' in his notes? Why did VP Cheney go on Meet The Press and deny that he knew who Wilson was months after he gave Libby the info? And why did the memo on Air Force 1 indicate that her identity was top secret, not even to be shared with friendly foreign gov'ts?

Why on earth didn't the White House just rebut Wilson's story in the press in a straightforward honest direct manner?

This whole think stinks and it makes me sad that we're not holding our side to the same standards as we claimed to expect from you-know-who.
