Rush emphasized the fact that the MSM is gleeful about its wish-fulfilment belief that Bush is so politically wounded by his poll numbers that he is a lame duck.

Rush dismisses this idea by referring to the Senate Judiciary Committee hearings, in which the Democrats' "best and brightest" have been unable to lay a glove on Judge Roberts. Rush says that Bush is reshaping the judiciary, which is now the linchpin of the Democrats' influence and remaining power.

And Rush emphasized how tunnel-visioned the media are, and how completely absorbed they are "in the moment." In, that is, their own news cycle - whether it is a day or an hour.

Rush did touch on your other story, FORGOTTEN NATIONAL TRAGEDY: BILL CLINTON AND 1,000 DEATHS IN THE "CHICAGO HEAT WAVE" OF 1995, but used a count of 967 or something like that.

No offense, but read what I wrote a bit more carefully. The dems have said they will grind Senate business to a halt if the Republicans exercise the Constitutional option. Thus, if the Republicans exercise this option the dems will refuse to cooperate in any committee hearing. No hearings, no judges.

No flip I do not believe Roberts is "sailing through." I just believe the next one is going to be 900 times worse.

It is also interesting to note that all that "consulting" that Bush did with the 'RAT senators for the O'Conner seat, he did not have to do for Reinquist's seat. By renominating Roberts to that seat, he effectively side stepped doing that process again.

Now all Bush has to do is produce the nomination for O'Conner' seat and watch the 'RATS have, not a cow, but a whole herd.

Perhaps they will, but that will be a dangerous last stand. For example, imagine if Janice Rogers Brown were nominated? A black woman, already confirmed. If they ground the Senate to a halt on her they'd get skewered. The Repubs ought not be scared of them. If they are scared, they will act like it and lose.

The Thomas hearings will be nothing compared to that one. Because the liberals know the court swings right with that selection. They will pile all the hate, crap, junk, hate, not supporting abortion hate, etc. on the candidate. With what they say, you will wonder why the candidate was not in jail instead of being asked to sit on the high court.

Assuming we get originalist conservatives to replace O'Conner and Rehnquist, it is the next seat after them that will make the difference. We need five for a majority.

To be sure, the tilt will be a little more conservative. Some of the leftward lurch will slow down. But until we have five, it will be pretty much more of the same and certainly we will not begin reversing decades of left-wing living-constitution decisions until the appointment AFTER the O'Conner and Rehnquist appointments. Until then, there is a solid bloc of left-wing votes to prevent that.

if they give in, their far left base will slaughter them. Second, if they force the Republicans to exercise the constitutional option, then they can use it as an excuse to not even give the next nominee a hearing. The Judiciary committee will not meet, no hearings, voila, no Bush Supreme Court nominee.
This has been a kind of balk move. Roberts was after all nominated, in the first instance, for the O'Connor seat. What does it mean, then, to say that the Democrats have any justification - even in their own minds - to treat Roberts as the replacement for Rhenquist, and not as the nominee to replace O'Connor? Clearly Bush would have nominated Roberts to replace O'Connor; before Rhenquist's death he did exactly that.

In effect Bush says that he will nominate who he will nominate - and it really doesn't matter who is being replaced. But of course it actually does matter who is being replaced; until the Senate votes in her replacement O'Connor still sits on the bench. And I have predicted that that will make it very difficult to get her replacement confirmed - so long as she doesn't resign outright both the conservatives and the liberals have something to lose if they consider her replacement to possibly be worse than O'Connor - which could very easily be a majority of the Senate.

My conclusion is that O'Connor will sit on the bench until she submits an outright resignation, effective on a date certain.

Bush making a third appointment to the SC...now that would be history indeed. He has two appointments so far. Only President Washington and President Bush has had two appointments from what I understand. But a third appointment would put Bush in a class by himself if he gets a third appointment.

Ostensibly that would be Breyer's seat as he is the oldest, but it could be (please let it be so) Ginsberg's seat.

Right now I am wondering if Reinquist passing while still a sitting SC justice might give the other older justices (Breyer, White, Ginsberg) pause to reflect and consider retirement.
