Again, from what Justice Thomas told me and my students in a LONG talk in February, the CJ is purely symbolic. The decision process, he said, was remarkably quick: even on the most divisive cases, it took 15 minutes for the justices to all state their opinion and vote. He said there is no jawboning, buttonholing, or Hollywood theatrics where people try to "persuade" others in the hallway. Their opinions are set when they have a meeting about a case. So CJ is really just the person who calls the meeting to order and nothing else.

I thought that was going to happen as well. I'm sure the Justices will uphold the utmost professionalism, but I wonder if deep down, Scalia was hping. Would have been interesting if he picked, Thomas also.

I heard a 2001 Rehnquist interview on CSPAN, yesterday. He explained that often the other Supreme Court Justices are not nominated because of the fear that it would cause animosity amongst the justices...feeling that they should have been there instead.

I prefer Scalia, but I imagine he just wants to avoid an additional fight. Still, I think CJ should have high court exerience (ruling experience).

The President is a genius! He appointed Roberts to be CJ replacing Rehnquist, thus keeping Sandra in until someone replaces her.
The court remains with 9 members.

As long as Roberts behaves as a bona fide conservative judge, this is a good move. Scalia will probably be more effective as an Associate Judge and Roberts is almost sure to be confirmed. The real replaced for O'Connor now is significant because Roberts replaces a reliable conservative vote on the court.
