I guess Scalia and Thomas just didn't want to go through the confirmation hearings again.

Whew, at least it saves another tirade and the personal degradation that these court battles have engendered.

Bet Scalia is breathing a sigh of relief, can you imagine what the Dems would do with that confirmation hearing??

Choosing Scalia would have required another round of confirmation hearings, which I don't think Bush wanted. This makes a great deal more sense.

While I would have liked to see Scalia in the position, this will leave for sure Thomas and Scalia as conservatives on the court and allow Bush to appoint another conservative. I guess it just fills the positions faster, given the road blocks the liberal dem's constantly throw up.

I had read that Scalia would resign if he didn't get chief justice. I think this is a slap in the face to both he and Thomas.

rts demonstrates two important behaviors. He is organized, and the Chief Justice has to be well organized. Roberts was a clerk under Rehnquist as well so he's familiar with how Rehnquist ran things and will more than likely run the Supreme Court the same way. Secondly, Roberts has a sense of humor. As difficult as some cases are it's a good thing to have someone who will keep a level head and still find some humor. Certainly, it would be nice to see the Supreme Court laugh some of these liberal exercises in judicial activism out of court.

Scalia or Roberts for top dog?....Long term strategy for best conservative verdicts?...

Personally don't have enough validated information to decide...

Roberts has been nominated as much for his confirmability as his conservativism. But the fact that Bush wanted him for Chief Justice all along is notable. He must know something that we don't.
