Newsreaders on FoxNews just said a 'Senior administration spokesman' has said Bush plans to nominate Roberts for Chief Justice position.

Certainly there are a number of ways to look at this, hard to really know which scenario discussed here would turn out best, albeit it doesn't matter much since GWB made his choice.
The main thing that stick in my mind is that we knew what we had with Scalia or Thomas, but then again I think GWB knew the Blamers were going to fight tooth and nail on their nomination for CJ, an outsider avoids any passed over feelings, and so since it looked like Roberts would get by without too much BS, maybe the President did the Country a favor. Guess we just have to hope that Roberts is the real deal..and have faith in GWB.

You mean like that of Justice Thomas? His vast credentials for a supreme court appointment came from his heading the EEOC and for serving as an under secretary in the Department of Education. His entire judicial career was one year, a year less than that of Roberts. They both served on the same appeals court. Both graduated from Yale, although Roberts got in on the basis of his grades and Thomas, an affirmative action candidate.
Anything is possible I guess, just as you've said.
Rehnquist marched to his own drummer and I doubt there's anyone who could make him do what he didn't want to do, when he wanted to do it. From what I've read the Bush team was initially preparing for Rehnquist to retire or perhaps die. O'Connor resigning moved the strategy to appoint Roberts. There was an article early this morning, on FR too I think, that said the plan simply changed back because of the Rehnquist death. Bush all along considered Roberts for the Chief Justice position because of his background serving both Rehnquist and Reagan, and confirmed by the interview Bush had with Roberts I'm sure. I think this came from a WH press briefing but I didn't see it.
I don't think anyone is backing off. It may be a temporary adjustment for the Democrats but I fully expect them to return to the attacks they started over Roberts. This morning the NOW gal leader wrote something already blasting Roberts and claiming his being Chief Justice would destroy women's rights. Dopey, I know. Still, the attack machine will crank up shortly. The Denver TV stations are still running the pro-Roberts ads to get support pressure on Senator Ken Salazar.
Notice too, Schumer and Dodd both suggested a waiting period yesterday and it was repeated on the morning shows today. I'm sure it was a trial balloon but the Bush announcement early this morning shot the whole thing down.
Yep, the "hapless toad" quote is from Roberts. He was, of course, referring to a genuine toad and not Dianne Feinstein.

The President is a planner and a leader..........and he is trustworthy.
I like this move...........and I'll bet Rehnquist did too.
The problem is not a problem of "RINOs"
The problem is that the vast majority of Senators from both parties come from a social and cultural background that makes flexible Constitutional interpretation Holy Writ.
My standard for both content and process is Ruth Bader Ginsburg. Radical, Leftist, feminist, ACLU counsel dedicated to overthrowing the Constitutional order - clear public record, no need for questions.
Among Senators, this nomination was noncontroversial. All Democrats voted "yes", 41/44 Republicans also voted "yes".
Our nominee, to offset Ginsburg, should be radical, rightist, publically Christian and NRA counsel.
To even say it is to point out the absurdity.
How many of your 50 non-RINOs would vote for a Ruthh Bader Ginsburg of the right?
And after you answer that question, answer this one, much more important:

The partisan split in the senate goes back to the Reagan years and Robert Bork. It continued through Bush senior and Clinton and to this day.
Me too! Either Justice Scalia or Justice Thomas would be good. I don't know enough about Roberts.

I think this plan was an option all along, should Renquist die.
I give the staff and the President credit for being able to put together plans for such scenarios.
Katrina was unplanned, as were the problems.
The reason you don't want to appoint a Ginsberg to be Chief Justice is that the Chief Justice gets to sway which cases to hear. What was great about Rehnquist is that he vastly limited the number of cases the Supreme Court would hear and lengthened the duration of time spent on these cases. This limits the power of the judiciary to some degree and does a better job of maintaining the status quo that just blazing through case after case.
Other major factors:
1) If on the winning side, the chief justice decides who writes the majority opinion.
2) The Chief Justice presides over any impeachment hearings of the President or Vice President.
Once again The liberal democrats(the left)and MSM have shot themselves in the foot.The leftist drumbeat that we have been hearing against Justice Thomas all these years has come back and bit them right on the ass.How can they now bring out all the old cliches and racial charges that Bush has passed over a Black justice.Howard Dean could not have planned this better.
