Leading Senate Judiciary Democrat Charles Schumer said Sunday that he intends to make gay marriage an issue in the upcoming confirmation battle over President Bush's pick to replace retiring Supreme Court Justice Sandra Day O'Connor.
"All questions are legitimate," Schumer told ABC's "This Week." "What is your view on Roe vs. Wade? What is your view on gay marriage?"
"They are going to try to get away with the idea that we're not going to know their views," Schumer complained. "But that's not going to work."
The top Democrat's mention of same-sex marriage in the same breath as his party's primary litmus test issue, abortion, raised a few eyebrows.
"How does he suddenly have the chutzpah to ask that as a litmus question when he himself opposes it?" WABC Radio host Curtis Sliwa wondered Tuesday morning.
Schumer came out against gay marriage in 2004, after New Paltz, N.Y., Mayor Jason West performed nearly two-dozen same-sex unions.
As a congressman in 1996, Schumer voted for the Defense of Marriage Act, which authorizes states not to recognize same-sex unions from other jurisdictions.
A pro-homosexual agenda is still a major plank in the DNC platform, and Schumer's comments make it all the more obvious.
I hope they keep this up. In fact, I hope that Durbin comes out tomorrow to suggest that freeing Gitmo terrorists is a "supreme court issue."

Maybe Sen. Schumer doesn't want to be outdone by Sen. Kennedy and his radical pro-homosexual She-Male bill?
Regardless, Schumer apparently intends to make an issue of it. No doubt it was because of the homosexual activists that are rife within the Democrat Party.

Not Schumer voted for the Defense of Marriage Act in 1996 ... isn't that when he was running v. D'Amato? A year or two earlier, he would have opposed it.
They will keep it up, you can count on that. The pro-homosexual agenda is here to stay within the Democrat Party.
The Democratic party is the gift that keeps on giving. I hope Chuckie and his liberal friends keep on talking...they manage to offend large groups of Americans every time they do.

Half of the Democrat base opposes homosexual marriage. If they believe 'mainstream' judges would legitimize gay marriage they'll be polling about 20-28% of the country max.
I don't see how. If he opposes gay marriage with both his opinions and his vote, perhaps he wants to ask about it so that a support of the same doesn't get on the Supreme bench.
This guys is nuts! Something like 74% of the American population support marriage between a man and a women and not homos. Here in Ohio President Bush won the state in a close election. However, there was a gay-marriage initiative on the ballot and 72% of Ohio voters voted it down. So even if 50% of the voters were Demos and voted for sKerry in a close election, at least 20% of Demos had to cross the line and vote against the gay marriage initiative to bring the total to 72%

Looks like the Dems are going to apply a litmus test for anyone who goes up for confirmation on a whole range of issues.
Didn't they say Republicans shouldn't be allowed to apply litmus tests like abortion to court nominations? Hmmm.
Democrats know that DOMA isn't SCOTUS proof. They can voice their support for DOMA all they want, but most likely they are hoping for, and counting on the fact, that sooner or later same-sex "marriage" will come before the presently liberal-leaning SCOTUS.
You know why dims are against guns? Because if the were as stupid with guns as they are with free speech, then they would shoot themselves in no time.
