Biden: Dems Will Filibuster Janice Rogers Brown

Sen. Joe Biden said Sunday that if President Bush nominates recently confirmed Circuit Court Judge Janice Rogers Brown to replace Sandra Day O'Connor on the Supreme Court, Senate Democrats will launch a filibuster.

"If [Bush] sent up Edith Jones, I could assure you that would be a very, very, very difficult fight - and she would probably be filibustered," Biden told CBS's "Face the Nation."

In the next breath Biden corrected himself, saying, "I misspoke, I misspoke. Janice Rogers Brown is what I meant to say."

Asked whether that would break the Senate's much heralded compromise last month not to filibuster judicial appointments except under "extraordinary circumstances," Biden explained:

"[The Supreme Court] is a totally different ball game . . . A circuit court judge is bound by stare decisis. They don't get to make new law. They have to abide by [legal precedent]."

Asked if O'Connor's retirement was more likely to provoke a filibuster than would have been the case had the more conservative Chief Justice William Rehnquist retired, Biden responded: "Probably."

I don't think they would filibuster Gonzales. The Democrats would let him through to show they are "reasonable" and then filibuster the next candidate.

This would be a great way to expose them for the rascists that they are. How will they be able to Filibuster her for months on end and then go back to pandering for black votes? Her nomination would be win win EVEN if she didn't get confirmed.

Oh it does scare the hell out of me! Biden along with Dodd and Kennedy and Up-Chuck, everytime I think about one hundred senators in a nation of three hundred million and this is what we get? Damn the New Jersey Compromise!!!!

Fine, but no more of these "virtual filibusters". Make the rats do the real thing. Make them shut down the senate by talking non-stop. Make every single one of them stay on the senate floor. Bring in the cots and the sleeping bags.

I'm sick and tired of the dems waving a finger and saying "oh, we'll filibuster that" and the republicans giving up without the dems having to put any effort into it at all.

You jackasses want to filibuster? DO IT!

I think that we have been watching a long drawn out drama which has been scripted for months if not years.

O'Connor retiring was rumored for months. Renquist will be next, and then Stevens will go if doesn't die first.

The replacement of Stevens is going to be where the big fight is, and if the idiots on the left fight this all out now, they will be out of gas and/or looking foolish when it comes to the Stevens replacement.

The Democrats are being played here.

There will be much teeth gnashing and complaining, but what can anyone do? It is his choice. That is why the conservative groups are trying to head off any thoughts of his nomination now.

If we can't affect the courts when we have elected pubs to both the legislative and executive branches of government, then this has all been a wasted exercise. It is time to squish the bugs and put jurists on the court to replace legislators.

This shows it all! - The SC is not suppose to MAKE law either! (yet Biden shows exactly what the Democrats want to use the courts for....to MAKE law).

No.....it is not his choice alone. Dubya has to gain approval of the Senate. Conservatives have opposed presidential Supreme Court appointments before why would they make an exception for a pro-affirmative action "moderate" like Gonzales? If conservatives rebel, he'll have to nominate a better candidate.

BTW, many conservatives supported Souter for the same reasons you state.
