Biden: Dems Will Filibuster Janice Rogers Brown
NewsMax.com ^ | July 3, 2005 | Carl Limbacher

Posted on 07/03/2005 10:52:40 AM PDT by Carl/NewsMax

Sen. Joe Biden said Sunday that if President Bush nominates recently confirmed Circuit Court Judge Janice Rogers Brown to replace Sandra Day O'Connor on the Supreme Court, Senate Democrats will launch a filibuster.

"If [Bush] sent up Edith Jones, I could assure you that would be a very, very, very difficult fight - and she would probably be filibustered," Biden told CBS's "Face the Nation."

In the next breath Biden corrected himself, saying, "I misspoke, I misspoke. Janice Rogers Brown is what I meant to say."

Asked whether that would break the Senate's much heralded compromise last month not to filibuster judicial appointments except under "extraordinary circumstances," Biden explained:

"[The Supreme Court] is a totally different ball game . . . A circuit court judge is bound by stare decisis. They don't get to make new law. They have to abide by [legal precedent]."

Asked if O'Connor's retirement was more likely to provoke a filibuster than would have been the case had the more conservative Chief Justice William Rehnquist retired, Biden responded: "Probably."

Good ... nothing better could happen than to expose the RATs with Justice Brown. Take the fact that they just confirmed her with Brown's position on property taking and they will have little of substance to claim for their actions. This might be better than the nuclear option ... let's call it the J-BAM option!

Nuke 'em.

I don't think using the "nuclear option" against the Dems is necessarily all that good of an idea, unless, of course, you're talking about using real nukes.

Justice O'Connor wrote in her resignation that she would serve until someone was elected to replace her. That means no recess appointments since their is technically no vacancy.

I guess that means we can nominate Edith Jones, though, right?

[The Supreme Court] is a totally different ball game . . . A circuit court judge is bound by stare decisis. They don't get to make new law. They have to abide by [legal precedent].

This is quite a statement from Biden. Someone in the MSM should really jump on it. Maybe Bill O'Reilly?

"Fine, nominate Janice Rogers Brown, if the Dim Rats Filibuster her, til recess, then recess appoint Bork."

What the heck is the damned fascination with BORK?? Bork is NOT any kind of reliable conservative. Read his views on the Second Amendment and find out how much of a RINO he is.

And there we have it. The entire Democratic mindset in a nutshell. They think Supreme Court justices are there to MAKE LAWS!!! Biden slipped up and just showed what a jackass he and his party is.

double "ahem"

Sorry, couldn't help myself.

You can't believe ANYTHING the Dems agree to. I just hope we can control the debate and throw it right back in their faces.

Biden just admitted on national TV that he willfully violates the required Article VI oath he has taken to support the Constitution - the Constitution that gives Article I Section 1 exclusive authority to create legislation to the legislative branch, not the judicial branch.

I don't get the fascination either. Bork is also far too old. If Bush is going to have a recess apointment for Brown, it should be Brown!

Luttig is clearly the best choice - we could put Brown up there, let them fillibuser and smear her, play the race card, withdraw her name, then put Luttig up there.

That would work. And we have the happy choice of either "nuking" the Rats', or letting them go into yet another mid-term election as obstructionists. Think about. Even if we don't nuke, it won't bother conservatives a bit if the SCOTUS is semi-paralyzed for a session with 4-4 non-decisions, but the swing-voters are apt to consider it a crisis (brought about by Dem obstructionism) and so are the Dems (either demoralizing their base, or driving it to demand further damaging and ineffective extremist posturing from Rats in congress).

Contrary to some pubbies, I think Frist has handled this just fine, and we got 'em right where we want 'em. Granted the Rats will do damage, but they'll do that anyway. The key is make the cost as high as possible.

It is beyond me how anyone could possibly take Joe Biden seriously. He and Ted Kennedy should be selling used cars somewhere. Instead, they're in the United States Senate. It's a head shaker.

".....They don't get to make new law."

With that casual remark --- Biden (the dumb) revealed the Democrat's concept of a Supreme Court Judge....

His comment reveals that he and most Leftist Lunatics - see the Supreme Court as their ONLY remaining ability to "make new laws" --- because they no longer control the Legislature...

The Leftist bastards want activist leftists on the SCOTUS to MAKE law, not interprete the Constitution...

Think about it folks..... This dumb ass is a SENATOR!!!!!

If that doesn't scare the hell out of you, you don't understand the problem..

Semper Fi

I believe they would even filibuster a liberal, just because he or she was nominated by President Bush

Really tipped his hand there. All this talk by the Dems over how another 'moderate' needs to be nominated to replace SDO implicitly acknowledges that the court is politicized, perhaps irrevocably.
