Oh, but McCain said "Frist was OK with this." To listen to McConnell a few minutes ago on the Senate floor neither he nor Frist would have accepted this deal.

It's MORE about moderate repubs flexing their muscles at the White House
and wresting control of the agenda from the Bush, Rove, and Frist and hard right.
It is a big slap in the face to Bush, Rove, Frist and the rest of the toadies.

The Republicans are no longer the majority in the Senate. Six Republicans senators switched parties tonight; whether anybody cares to admit it, or not. These six will never vote with the Republicans again.Yes, you hit it on the nail!... This was very important to us, and they showed us they are not with us... you can not count on these 6 or 7 sob's. They are "centrist," you know. That means that things are just "fine" with them, as they are.

Ya, that is what Graham said (well I will take your word for it that he said it, although I wonder if he made clear that if he doesn't like what some Dem thinks is extraordinary, he will go nuke this term). He is just protecting his rear in SC. If things get too hot for him down in SC after one of the gang of six Dems (and all it takes is one), thinks filibustering O'Connell (a very, very highly respected judge in both the IQ and temperament department but conservative) or Scalia for SCOTUS is extraordinary, he will just tell Hagel (or somebody else) to come out of the closet so that he can go back in.

that's the bigger picture.
This was a once in a generation chance. We had momentum, we had our ground troops mobilized.
We had the nation focused on the courts, and we had the opportunity to recenter the judicial branch of government.
But instead of that, our senators would rather see nice things written about them in the New York Times.
good riddance to a dozen "republican" senators come 06. And i say that with regret for what we might have done.

I can't read fast enuf to absorb all the comments here, BUT...
what did the Republicans lose? Nothing, that I have seen.
What did the Dems lose? The 3 judges who are "most conservative" will not be filibusted. And they did not lose face.
It looks like everything else is the same as usual.
Am I missing something? I know that the devil is in the details, but...

Are you sure that Frist had the votes?\
Yes. He said he did and I believe him.
Frist comes out of this one OK but this is only Round 1. The Pubbies scored on points and are ahead. The tragedy is Frist had a knockout punch and McCain and company wouldn't let him throw it. The Dems knew that Frist had the votes or they would have let the nuclear option go to a vote. The fact that they didn't proves it to me.
The good news is the deal did not give an inch on the nuclear option for the future. It is still their hanging over the Dems.
To: CasearianDaoist
"the Rinos have commited to voting agisnt the rule change no matter what the democrats do."
No, no, no, they haven't! Dear God in Heaven, why are people so insistent on reading what is not there? They have agreed to do this as long as the Dems keep up their end of the deal, which is to not overuse the filibuster as they've been doing. If the Dems start filibustering like crazy again after these three, bang, deal over, and we can go back to the nuke option. The signatories themselves have made this point clear already!
WOULD THE HOTHEADS HERE PLEASE SWITCH TO DECAF AND STOP PANICKING!
The Dems dodged a bullet today and they darned well know it. They came *this* close to losing everything, all of their judicial power, for the next thirty years. It may yet happen, but will happen more slowly and at a later date (unless the Dems decide to be stupid and go right back to filibustering in a few months).

I meant that for those who were about to throw themselves off a cliff. I heard some say they were abandoning the party altogether...some were never going to vote in any election again. Yes it's a serious matter, but I just didn't think it was worth going overboard over.
We're stuck with a RINO where I live...I can always write in another candidate or vote third party. Doesn't help -- he keeps on getting elected. But I still think my votes counts. I just think it's important to vote, no matter what happens.
To: Torie
Reid will just mention a phantom FBI file to smear another judge. Then what? Can't disprove it because it can't be shared. And won't reprimand Reid for it either.
That's all they have to do.
To: econ_grad
You mean like you just did? Projection is not pretty.
Why don't you try actually defending your thoughts on this subject rather than childishly calling people names.
Oh wait, you can't.

We need to get McCain out of power no matter what. No more of this "but he's a Republican" business. He's not loyal, so we needn't be either.

I think you are overstating in your post.
The supreme court has not come out in favor of infanticide which is not abortion.
The Supremes have not destroyed the family, our culture is doing that without their help.
The gay lifestyle is acceptable, or their right to it is accepted by most. What would you change in that?
They have not rejected the 10 commandments, just indicated that posting them everywhere is not appropriate in government buildings. And have indicated that this country is made up of more than Christians or even any other religion. I don't like everything the Court has done but you are overstating the case in my opinion.
To: Kenny Bunkport
So, the Dems retreat to regroup; we get three of our most conservative nominees; and we all live to fight another day. That's the bottom line. There is much more to it than that. Living to fight another day is fine when you are the one that is a certain loser. If we had a substantial probability of winning, we have lost by "compromising". We have lost in a major way.
The Dims are emboldened, convinced (correctly so) that the senate pubs have no stomach for hand to hand combat, or taking casualties. They called our bluff...and we wavered. Next time they will be even less likely to believe the pubs will follow through.
Sometimes you have to do something because it must be done. So, we get a few nominees through, temporarily. That is not really the point now. It's the damage to us, the supporters, that matters. Again, so we get a *few* nominees through at present. How does that compare with the lost support, votes, money and sweat that will no longer come from a LOT of the faithful?
Sometimes the real issue is who is in charge; not just getting along. The senate pubs have sown the seeds of much bigger problems from the Dims by blinking now. Empty threats will come back to haunt the pubs in a godawful way. Guaranteed.

Response to Original message
When all the folk claiming 'victory,' irrespective of 'party' awaken to reality, the reality is that 'extraordinary circumstances' is a hurdle no minority party will ever clear.
Our founders understood the critical necessity for 'checks and balances' and the unrestricted use of 'filibuster' for 200 years has enabled the minority party to represent the will of those who elected it.
So, let's take a poll. Any of the below options work for you? Or, please suggest your version of an 'extraordinary circumstance.'
Peace.
Re: Sorry UL
Can't play your game.
We are the minority and we saved the filibuster. The glass is half full, not half empty or totally empty.
Consequences of this are as follows:
1) Frist is done. He can't even lead a majority. He didn't get his Up or Down vote as he promised, as he crusaded he would. Fristianity no more for 2008. He promised his base he can deliver this, and couldn't. Not only that, the American people want compromise. Instead, he told everyone how unhappy he was that there was bipartisan compromise. HORRIBLE political move.
2) The Moderate Republicans showed their strengths and that they were a force to be reckoned with. They didn't back the Weed's agenda. McCain and the rest of the moderates form a fifth column in the senate. Its like the moderates have had enough and want their own voting block.
This is a SOLID democrat victory. WE are the minority, yet we were able to save the filibuster, to use again. That extreme language is crap and you know it.
WE WON - be happy.
