Mr. CORNYN. I ask unanimous consent that when the Senate completes its business today, it stand in adjournment until 11:30 a.m. on Monday, May 23. I further ask that following the prayer and pledge, the morning hour be deemed expired, the Journal of proceedings be approved to date, the time for the two leaders be reserved, and that the Senate then return to executive session and resume consideration of the nomination of Priscilla Owen to the Fifth Circuit Court of Appeals, provided that the time from 12 noon until 1 p.m. be under the control of the majority leader or his designee and, at 1 p.m., the Democratic leader or his designee be recognized; provided that floor time then rotate between the two leaders or their designees every 60 minutes until 4 p.m., at which time the majority leader or his designee be recognized until 4:45 p.m., to be followed by the Democrat leader or his designee from 4:45 p.m. until 5:30 p.m.

Mr. CORNYN. Mr. President, on Monday, the Senate will resume consideration of the nomination of Priscilla Owen to serve as a circuit judge on the Fifth Circuit Court of Appeals. Monday will be the fourth consecutive day the Senate considers the Owen nomination.
Over the past 3 days, a number of Members, on both sides of the aisle, have come to the floor to speak on the nomination. We have conducted over 25 hours of debate, and we will continue on Monday. Moments ago, we filed a cloture motion on the nomination, and that will ripen on Tuesday of next week.
On behalf of the majority leader, I remind my colleagues the leader has announced our next rollcall vote will occur Monday afternoon at 5:30. That vote will be on a motion to instruct the Sergeant at Arms to request Senators' attendance. Senator Frist will have more to say about next week's session on Monday.
I'd rather see Janice Rogers Brown nominated as SCOTUS Chief Justice. I wonder how Donna Brazile would view a vicious attack on JRB? If we can peel off 25% of the Black Vote, our grip on the reins of power in DC will be ensured.

I believe politics has changed... It's a different ball game. A lot of the old rules (i.e. the Senate country club [smile]), has changed as well. The Religious right/social conservatives, finally got tired of taking it in the Chin... and look at it flexing its power now. And I predict it will become even stronger and why you ask? (you did asked,didn't you :), because we have NO CHOICE. If we don't defend our values, they will eat us alive.

Ahhh. I think I get your argument. Byrd changed the rule that set the order of business when the Senate entered executive session, and did so on a simple majority basis; therefore it is okay to change a rule that determines how the Senate arrives at the point where it takes a vote.

In 1975, the "change the rule" rule was in place, as part of Rule XXII. That requires (still in there) 2/3rds of the members present and voting in order to change a rule. It passed with more than 2/3rds of the members present and voting. I.e., the change to 60 votes to get cloture was decided by more than 2/3rds of the enators present and voting, just as the "change the rule" rule reuqired, and still requires.

No, I think we NEED liberals - at least a few - as examples of the wrong way to think and do things. Otherwise how would we know? As it's difficult to fully appreciate a sunny day if there are too few rainy days. No dark, how do you know it's light?

It's my understanding that what they're doing is seeking clarification of the rule, which would be a ruling from the chair.
If they're doing something else, I don't know. They've been shouting all week how there is no rule that judges can be filibustered.

Why not make the democrats actually filibuster? Why is it in the last congress that they would call up these several cloture votes to end debate on something that was not even being debated. Only in the fake counter filibuster was there any kind of debate. And during all of that, as now, a quorum is not present in the chamber to force the other senators to sit and listen. Why not call for a vote on this option sooner and even if it failed, to call a point of order over an over to draw attention to this. We had Zell Miller and John Breaux in the last congress who would have voted for it. How about denying Specter his chairmanship so these nominations would move to the floor faster. How about putting the democrats on the spot for a change. He's done nothing.
Now we're supposed to cheer him because he does something.

I would concede the former but the latter did not have American Idol and ESPN so I contend they actually did care about the outcome.
I thought at the time that Specter's going to bat for Thomas was a CYA move to make up for his opposition to Bork.
