Just because you don't use an option, even if you don't get what you want or what should be, doesn't mean it isn't still a viable option. It may simply mean that the Dems didn't invoke it simply because there weren't enough members willing to invoke the filibuster even if they were willing to vote against him. Paez was confirmed with less than 60.
16 Senators can invoke the non-debatable mechanism of cloture.
I do agree though, that presence of a tool (e.g. cloture) does not mean that tool MUST be used.

I just called Richard Burr's office, who is my senator; I pointed out to the guy on the phone that the "Compromise Committee" is bargaining away HIS vote on the floor of the Senate, which is what I voted for him for!
And I am going to hold any Republican who lets them bargain away THEIR vote just as reponsible as the ones doing the dealing.

It would guaranty that judicial nominees would not be held up in committee. How do you all think Spectral will take to that? Even Reid was arguing this morning that no nominee should be bottled up in committee. Why, that's what all those DEMs meant back in the mid-1990's.
