C. Borden Grey just pointed out that IF the fillibuster option really WAS available and had been used before the Dems would have used it on Clarence Thomas! It wasn't and they knew it -- so that's why they had to produce Anita Hill and trash Thomas that way.

Yes, that statement by Chris should be given to every pubbie in Washington.

It drives me nuts when I hear the Dems comparing their filibusters to pubbies holding Clinton's nominees in committee.

IT'S CALLED BEING IN THE MAJORITY, YOU IDIOTS! WHEN YOU'RE IN THE MAJORITY YOU CONTROL THE COMMITTEES.

If you follow the dem's "reasoning" they seem to be saying it should make NO DIFFERENCE whether a president has a congress controlled by his own party or not. Oh yeah, right. And yet they get away with it.

You want the Truth? I would have been willing to work with the Dems. Even accepted some compromises in the first couple of years of Bush's term. But the Dems didn't want that. They went into the gutter, made conspiracy theories the center of their politics and betrayed this country in time of war.

Now my attitude is to make them kneel down and kiss our butts. Not because I enjoy groveling but because they have convinced me they don't have one damn bone of decency in their bodies. I am now convinced they don't care about this country, they only care about power. This is why I think they should be forced to wander the wildness for forty years till they have all died off before being allowed back in the promised land.

They brought me to this point. they convinced me their souls were empty.

There was an analysis I ran across yesterday from somewhere (NRO, CQ, other FR?) about the Constitution and supermajority requirements.

Essentially, they put side-by-side the clauses having to do with senate advise-and-consent by 2/3 on treaties, with senate advise-and-consent [amount, notably blank with majority implied] on judicial and other presidential appointments. Clearly, the lack of supermajority mention decrees majority is sufficient.

I saw another source, possibly the same one, that mentioned dates that this question was debated in the Constitutional convention. They discussed this with three possibilities: supermajority, advise/consent and president appointment without advise/consent. After discussion, the Framers of The Constitution clearly intended majority advise/consent approval of the Senate in this case to be sufficient, and wrote it that way, and ratified the document in this form.

Up until now (two years or so ago), that was always understood, and it was the only provision ever voted on in the history of the country regarding this issue. If they wish to change that, the Senate and House must muster a 2/3 majority to start to AMEND the Constitution.

That is why C. Borden Grey pointed out that the filibuster was NOT available during the Clarence Thomas process.
