Then be sure not to let your child get married and appoint his or her spouse as their health agent.
'Health agent' is not an 'appointed' position. 'Next-of-kin' status is a legal derivative of marriage. Just because something is technically 'legal' doesn't guarantee that it is always 'right'. In terms of pure legality, this case is a farce anyway because it has hinged on Schiavo's 'hearsay' testimony that death is what Terri would have wanted.

From the posts on this subject, I would guess there were some FReepers joining the DU'ers with their votes. Never thought I would see that but some things make strange bedfellows and everyone has a right to their opinion, eh? I quit poll-watching during Pres Bush's first term.

"The whole purpose behind the private bill was to give Terri Schiavo and her parents a fresh look and hearing in federal court. Although the federal judge was instructed by the law not to use or defer to Greer's prior determination, it appears he has done just that, commenting in his decision that the matter has already been looked at in state court.
PRECISELY!!
This judge overstepped his bounds and committed a terrible error, in my opinion.
This decision of his absolutely has to be overturned, if I am reading the intent of this law correctly.

** This is basically what Gerald Treese (sp?) said this AM. He is a local law professor in Houston and has been in the media for years. He has always seemed to know his stuff.
From what he indicated it appears to me that what Whittemore did was somewhat expected and that the key is getting it to the 11th Circuit Court of Appeals in Atlanta where they will likely say that the feeding tube be reinserted pending a decision.

Good. Does that mean when they affirm the trial judge, Freepers will come to grips with this story?
The only grips I'll ever come to with this story is that we live under a judicial tyranny. A government that allows an innocent woman to starve to death, is by definition immoral and illegitimate.

But I don't know if it can be introduced into the legal proceedings at this time. I am a legal layman, but I am wondering if it is possible for appeals courts to entertain new evidence? I think they are limited to reviewing the original case from a legal procedural viewpoint. Yes, that appears to be the problem. Congress intent was for the Federal court to see new evidence by starting anew, which judge Whittemore chose to ignore. The rigidity of the system may kill Terri. Let's hope the 11th has more understanding.

I was a nervous wreck last night and I am even more so now. What the heck is wrong with these judges???? I am sick to my stomach over this!
A clintonian appointed judge, what else should we expext?
Maybe a Janet Reno "Elian Gonzales-action" to save Terri would be the solution!?!

Could anyone share their thoughts on Jeb Bush concerning Terri? I haven't heard anything from him in the last week and I wondered after hearing the nurse on Fox this morning speaking about Terri's husband attempting to murder Terri by injecting her with insulin. Where is Jeb Bush? I was hoping he might run for President in 2008, and now his silence is deafening. My opinion of him is changing quickly. If anyone can tell me anything he has done positive for Terri lately? Has he ever visited her? I agree with the person who said that Terri should be taken into protective custody, but it should be Jeb Bush who stands up and does it.
