"At this point, he is showing them who's boss, so to speak. It is a total power-struggle."

That's what I thought....poor excuse for a human being he is.

Breaking News is right!

Looks to me like the Good Lord does not want to take her back yet from the Earth. There are other divine plans for her it seems (with this ruling).

(Perhaps) His will is that she stay where she is and stays put for the time being. Despite what some judicial tyrants and others would wish, and would conspire in their human foolishness.

Why does this have to be so difficult? Award custody of Terry to her parents and send him packing. Then there won't be this controversy.

Exactly ! All this going on and on when there is a very simple solution.

This has to be causing much unnessary stress on her parents.

I cannot imagine their pain and suffering. It breaks my heart.

Because then the $1.4 Million that was supposed to be spent on rehab, will be spent on rehab, instead of his new honey.

Perhaps it is, I am utterly shocked that Greer did this, in light of his previous rulings.

As most policies see it, removing life support from a person who has been found by doctors to be in an unrecoverable state is NOT killing. I'm not saying that the judgement that she is unrecoverable is correct, just that from the policy's perspective his action would not be "killing" the same as it would be if he had shot her or something like that.

Sorry. Common sense has little or nothing to do with the law. As someone once said, "The law is an a**."

They probably don't grant a divorce because one of the spouses has to request it first. Michael won't do it for perhaps several reasons and I believe one is that his girlfriend and mother of his two kids wants to marry Michael in the Catholic church and divorce won't cut it. Terri can't request it because Michael is her legal voice and he won't.

I don't know if a spouse has to request an annulment and I haven't seen any discussion as to whether that has been sought by Terri's parents. Surely, if the Kennedy boys can get an annulment, Terri ought to qualify for one. But,that is an ecclesiastical matter and has no legal effect. It would take care of the remarriage issue.

It is a tragic situation and Michael is holding all the cards. I have little doubt that most, if not all, the money is now gone and even insurance proceeds would be eaten up by legal fees unless the cases are being handled pro bono and even then costs would eat up a lot.

I hope Michael will just walk away from this one, sign Terri over to her parents, write a blockbuster book, make his kids legitimate and live a private life again. I think it would be win-win for all.

Went looking for info on the Judge. Seems he has a long history of ignoring the law when it comes to abused women:

and a little bit of possible explanation for the honorable judge's behavior: http://hyscience.typepad.com/hyscience/2005/02/the_hapless_mis.html

he stands to inherit a million dollars when she dies. that's why he is so anxious to starve her to death.

I read that the company she worked for was bought out by another company and no longer exists. I suppose a policy would be honored by the new company.
MS's girlfriend [live-in] whatever, is also connected to the insurance business. Looks like he covered those bases.

As I understand it...

Michael doesn't want Terri to speak so death is key in his mind. Yes, there's a life insurance policy (don't know how much $).

There's enough people that would be willing support Terri's care, and pay him the life insurance he so greedily desires.

Thanks for your thoughtful comments to my question.

"...Where does common sense come into play?..."

As my dear departed father used to say......"Common sense isn't" The older I become, the more I believe he was correct.....common sense is the exception, not the norm.

He admits to the power struggle. September 27, 1999 Deposition, Michael Schiavo

Q. Have you considered turning the guardianship over to Mr. and Mrs. Schindler?

SCHIAVO: No, I have not.

Q. And why?

SCHIAVO: I think that's pretty self explanatory.

Q. I'd like to hear your answer.

SCHIAVO: Basically I don't want to do it.

Q. And why don't you want to do it?

SCHIAVO: Because they put me through pretty much h*** the last few years.

Q. And can you describe what you mean by h***?

SCHIAVO: The litigations they put me through.

Q. Any other specifics besides the litigation?

SCHIAVO: Just their attitude towards me because of the litigations. There is no other reason. I'm Terri's husband and I will remain guardian.
