NEW BEDFORD, Mass. -- A man who shot and killed another man on his property has been indicted for second-degree murder, according to prosecutors. The grand jury indicted Charles D. Chieppa, 56, for the July 17 shooting of 26-year-old Frank Pereira Jr. with a rifle.The fatal shots were fired near Chieppa's property just before dawn. By sunrise, motorists drove past Mr. Pereira's body, honking their horns and shouting in support of the shooting, the Standard-Times of New Bedford reported.
Chieppa, a Vietnam War combat veteran, lived in his parent's old home and largely kept to himself, neighbors said.
The home was next to Alfie's bar, which is known for drug dealing and prostitution. Pereira had snatched a purse from an Alfie's patron just hours before he was shot, police said.
Police had initially said the shooting happened when Chieppa confronted a burglar breaking into his home around 4 a.m. A day later, detectives acknowledged that they were investigating whether Pereira had actually entered the house before Chieppa opened fire.

Unfortunately- the way the laws are written- you cannot shoot someone to protect your property- only yourself!He will be off due to no priors etc but I am sure the media will paint this dead kid as a saint that went bad due to poverty and uncaring parents and teachers- BWAAAHHH
With all due respect, that's not a "universal rule".
In my Village (in IL, but 'red' DuPage County) we are allowed to use deadly force to, "protect life and property".
Our Village's firearms laws consist of one half of one type written page (unlike Chicago's 69 pages) and I reread it over and over again to make sure I was reading it correctly, but that's it, "life and property".
Anyone actually utilizing this "defense" better have a fat bank account....cause it's just a defense and an attorney will have to get you out of trouble...
Also...this defense does not shield one from civil penalties....so the beat goes on....
The liberal MSM NEVER reports the incidents that shine gun owners in a positive light. I would like to see statistics map of the U.S. showing gun ownership versus non gun ownership and the associated crime rates. I would be very surprised if it showed anything other than lower crime rates in higher gun ownership areas.
I am not a lawyer, but I believe that here in Massachusetts the law is that you must exit your house if there is an intruder, unless thst is not possible. Only then can you use lethal force (assuming of course, that the local police chief has granted your application for a gun license based on his determination that you have a "legitimate need.")
GRIN...actually, the question is, "How bad do I want that TV?"
Well, in Virginia, if you kill someone, it is presumed to be second degree murder, so I would not kill someone over property in Virginia.

I have made it clear in all my posts that in Texas, this is a "defense to prosecution" not an immunity......plus I do not recommend the use of deadly force to recover hubcaps or TVs.....
He should be rewarded for ridding the earth of another piece of scum.

If ya got a good size kitchen butcher knife (and the perp had had access to the kitchen) AND you can get near the body without leaving alot of trace evidence, leave the knife near the body.
Tell the cops he said he was going to kill me. Keep it simple. Stick to a simple explanation.

The victim...is 56 and the perp was 26 and coming from a bar next door... with a rep for prostitituion and drug sales...(you can bet plenty of violent criminals as well)....
Too bad he didn't have a fenced in yard and at least one good dog on the property......preferably a pit bull
