Ohio Supreme Court Rules to Allow Challengers

This cause originated upon the filing of a complaint for a writ of mandamus. Upon consideration of relators’ motion for an emergency peremptory writ of mandamus,

IT IS HEREBY ORDERED that relators’ motion be, and hereby is, granted, and that a writ of mandamus be, and hereby is, granted to compel respondent Secretary of State J. Kenneth Blackwell to reissue and enforce his October 26, 2004 Directive 2004-45 to all eighty-eight counties insofar as it permits, in accordance with R.C. 3505.21 and 3506.13, one duly designated challenger per precinct and, after the polls close, one duly designated witness per precinct, no matter how many precincts vote at a single location.

IT IS FURTHER ORDERED that a writ of mandamus be, and hereby is, granted to compel respondent Franklin County Board of Elections and the remaining eighty-seven county boards of elections to comply with this directive. This order is based solely on this court’s interpretation of state statutes.

FoxNews just stated that the 6th Circuit Appeals court reversed both federal court rulings!!!!!!~!~!

Yesss!! And that means the only path the cheating dems have is the USSC! I don't think you're going to get them to rule tonight.

Nice try, dems. You thought you could steal one that easily! You'll have to at least hide your actions now.

OK, so if this federal election law they are ruling on does this mean the observers in all states are now illegal?

:-) This is sweet. I just saw David Bois on the PBS News Hour a little whicle ago trumpting the 2 Ohio Federal District Court decisions as if they were somehow definitive proof of "disenfranchisement."

I share your sentiments, but you're a little late; John Glenn retired in 2000 and was replaced by Mike DeWine. Ohio currently has two Republican senators, DeWine and George Voinovich. George will win re-election tomorrow by 25-30 pts. I'm not a big Voinovich fan--he refused to back all of President Bush's tax cuts--but he's a huge improvement over Glenn, who sold his soul to Bill Clinton and the Democrats long ago.

The man to watch in Ohio politics is our Secretary of State, Ken Blackwell. He is the rising star in the Ohio GOP. He'll run for governor in 2006, replacing that RINO Bob Shaft, er, Taft. Blackwell scares the Democrats to death. Not only has the fought them tooth and nail on voter fraud, he's leading the successful charge for Proposition 1 (to outlaw gay marriage) and he's African-American. He has tremendous appeal across racial lines and the ability to shatter the Dims stranglehold on the black vote. That's why the Dims are trying to demonize him now; he's a huge threat down the road, both at the state and the national level. Blackwell for Governor in '06, and U.S. Senate in 2010, when it will be time for George to go home to Cleveland....

The vote was 4 to 3, there are seven members of the Ohio Supreme court. Still close, but in the end they interpreted the law correctly.

Points to the continued need of Bush appointing federal judges and not Kerry.

Actually it appears to be both. The law breakers and law corrupters have been double smacked. We won't be so lucky in some other places I am afraid.

Yes, they will reverse it.
Dems are stopping short of going to the Ohio Supreme Court because they know they can't win there.
