Kerry/Edwards lawyers warn TV stations over Swift Boat ad

In Rush's closing segment he said that he just received a story or document saying that lawyers for both the Kerry and Edwards teams were sending out letters to TV stations warning them about showing the Swift Boat Veterans for Truth advertisement!

Why do I think it's because Kerry couldn't win a slander suit against him....

Terms associated with libel cases:

Actual Malice is what plaintiffs in the public eye have to prove in order to win a libel case. Actual malice is the act of publishing or broadcasting statements with prior knowledge of the inaccuracy of the statement or a reckless disregard for the truth.

"Public Principle" refers to the heavier burden of proof carried by public figures such as entertainers and politicians than that carried by private citizens. Public principle is grounded in the belief that these persons ought to expect a thorough examination of their public actions. Also, public figures have an advantage over private citizens because they have access to the media to respond to criticism.

Typical of Kerry and Edwards to resort to lawsuits rather than actually refuting each charge with facts!

Any real journalist will ask him "Here is charge number one. Specifically, is the doctor who treated you lieing about your injury? Charge number two..."

Maybe those questions will be asked rhetorically on Fox News, but you can bet he won't put himself in a position to have to answer directly. Sad that with all our billion dollar media we can't get simple questions asked and answered in a presidential election.

Think Sandy Berger. Think Juanita Broderick. Remember that interview? It aired one time, right? Then nothing.

Each time an issue comes up and we think, oh, for sure now this will open eyes, it gets glossed over and left in the dust.

Kerry will not be "damaged" because the other side will vote for anybody but Bush no matter what. And the media will back anybody but Bush no matter what.

I thought the ads were selected small market buys. This threat of a lawsuit almost assures national news coverage, which even is better than buying a national ad. :o)

This is probably the reason they used Edward's voice and the invitation he issued at the convention

Edwards "spend 3 minutes" comment was at a rally at NC State University a couple days after his selection as VP was announced.

Forgive my ignorance but how does one do a "Denial of Service attack"?

You write a program that simulates 100's of thousands of actual users, and just tie the computer up trying to respond to phony requests.

This is probably not an attack, they are being overwhelmed by actual users. It's not easy to spec a web site that can handle sudden peaks. Just ask JimRob.

Well when Sean Hannity had some of the veterans on the air last week he was unwilling to agree to calling Kerry a traitor.

What else do you call a man who marches under the enemy flag in protest during a time of war? What else do you call a man who gives false testimony to war crimes?
