Soldier's Family Set in Motion Chain of Events on Disclosure [Hackworth involved in CBS photos]
NY Times ^ | 5/8/04 | James Dao and Eric Lichtblau

CUMBERLAND, Md., May 7 — Ivan Frederick was distraught. His son, an Army reservist turned prison guard in Iraq, was under investigation earlier this year for mistreating prisoners, and photographs of the abuse were beginning to circulate among soldiers and military investigators.

So the father went to his brother-in-law, William Lawson, who was afraid that reservists like his nephew would end up taking the fall for what he considered command lapses, Mr. Lawson recounted in an interview on Friday. He knew whom to turn to: David Hackworth, a retired colonel and a muckraker who was always willing to take on the military establishment. Mr. Lawson sent an e-mail message in March to Mr. Hackworth's Web site and got a call back from an associate there in minutes, he said.

That e-mail message would put Mr. Lawson in touch with the CBS News program "60 Minutes II" and help set in motion events that led to the public disclosure of the graphic photographs and an international crisis for the Bush administration.

It is still not entirely clear who leaked the photos and how they got into the hands of a "60 Minutes II" producer. What is clear, however, is that the furor over the photos is unlikely to dissipate any time soon.

And it may only get worse.

Defense Secretary Donald H. Rumsfeld disclosed Friday that there were "many more photos" and videos of abuse that have not yet become public. And he acknowledged in Senate testimony that the military might have mishandled the affair by not alerting members of Congress and the public to the growing seriousness of the military's investigation into the abuses before the images became public on "60 Minutes II."

"I wish I had been able to convey to them the gravity of this before we saw it in the media," Mr. Rumsfeld said.

The irony, Mr. Lawson said, is that the public spectacle might have been avoided if the military and the federal government had been responsive to his claims that his nephew was simply following orders. Mr. Lawson said he sent letters to 17 members of Congress about the case earlier this year, with virtually no response, and that he ultimately contacted Mr. Hackworth's Web site out of frustration, leading him to cooperate with a consultant for "60 Minutes II."

"The Army had the opportunity for this not to come out, not to be on 60 Minutes," he said. "But the Army decided to prosecute those six G.I.'s because they thought me and my family were a bunch of poor, dirt people who could not do anything about it. But unfortunately, that was not the case."

Many of the incriminating photographs appear to have been taken on a digital camera by a soldier in the 372nd Military Police Company who is now facing a court-martial. From there, they appear to have circulated among military personnel in Iraq via e-mail and computer disks, and some may have found their way to family members in the United States.

But there are still numerous unresolved questions about the photographs. One is why they were taken. Some officials suggest that soldiers wanted the photographs as souvenirs, but some relatives said they believed that the photographs were going to be shown to other prisoners to pressure their cooperation.

Then there is the question of how the photographs became public.

Lt. Gen. Lance Smith, deputy commander of forces in the region, testifying Friday before Congress, said he was still unclear how that happened. "It was a surprise that it got out," General Smith said.

Military officials were aware of two disks with photographs on them that were part of continuing investigations, one in Iraq and another in Washington, he said.

"That was the limit of the pictures, and we thought we had them all," General Smith said.

Producers at "60 Minutes II" are not saying exactly how they got the photographs. But Jeff Fager, the executive producer, said, "We heard about someone who was outraged about it and thought that the public should know about it."

Digital cameras have become so ubiquitous in the military that many relatives of personnel in the 372nd and other units in Iraq said they routinely received photographs by e-mail. But the photographs were usually tourist-type photographs of smiling sons and daughters, relatives said.

Officials said that the photographs showing psychological or physical abuse numbered in the hundreds, perhaps more than 1,000, with Mr. Rumsfeld hinting Friday that more may come out.

Among some prison personnel in Iraq, the photographs were apparently an open secret. "Some soldiers in Iraq had them — I'm hearing that soldiers were showing them to everybody," Mr. Lawson said. He said he did not have the original photos and did not turn them over to anyone.

The photographs have now turned soldiers like Mr. Lawson's nephew, Staff Sgt. Ivan Frederick, and Pfc. Lynndie R. England into graphic symbols of military abuse. But for Mr. Lawson, they are evidence of a complete breakdown in training and authority in the Iraqi prison system.

He shared his frustration in his March 23 e-mail message to Mr. Hackworth's Web site, writing: "We have contacted the Red Cross, Congress both parties, Bill O'Reilly and many others. Nobody wants to touch this."

Less than five weeks later, images of his nephew — interviewed on "60 Minutes II" with Mr. Lawson's help — would be shown around the world. Far from untouchable, the story would become unavoidable.

While I agree with most of your post, this part I just can't.

"Let's leave out political motive to CBS,just indifference to the result."

This is what Hillary Clinton said yesterday, as a member of the Armed Services Senate Committee:

Clinton: The focus on the pictures being released is, with all due respect, missing the point.

The release of these pictures was a violation of the Geneva Convention. And as one who was quoting the Geneva Convention in her "questioning" she should have known it.

Not to defend Hackworth, but he didn't do this. These "soldiers" did it. Maybe he takes some pleasure in giving it to the brass, I don't know. But I don't believe he can be blamed for this any more than LIFE magazine can be blamed for My Lai.

The only question about these "soldiers" is whether their story that Intel people told them to do this holds water. I think the pictures don't back that up. These perverts are having way too much fun posing for the cameras.

Who could tell?..The girl, another heretofore, sweet young do gooder type will be the best source of information on that.

I trust nothing Graner says. He knew better. He is obviously a control freak who beat his wife, stalked, harrassed and videotaped her. I'll bet he never takes responsibility for anything he does.

MI needs looking at.

We are not running a church school, but a prison with people who may have blown up our military and innocent Iraqis. I expect all legal means to be employed against them and don't blame any soldier for lapses in the heat of things. Pictures for remembrance are not taken in the heat of things.

Oh no, I agree these freaks are ultimately at fault. What infuriates me about this matter is that the system was working. There was an investigation, people were going to be charged and then these idiots decide to turn it upside its head.

Really caused a huge problem. Hackworth, the fools who thought that by contacting him, their relatives might get off, CBS, for broadcasting the images, some of the Dems who latched on to this...

Not trying to be flip here, but this all queer eye for the Arab guy. Really made those soldiers out to be a bunch of S/M queers. Embarrassing.

I meant "if you leave out the political" ...I know CBS has a political reason. I was trying to imply that even if you say they had no political motive, they were indifferent to the harm done....

I don't think anyone but governments themselves are under the convention. Of course this time the messenger will get off without being killed!

Hillary has eyes planted all over. She seems to have had the report before the Secy. of Defense did. Release of the pictures did not bother her, not what mattered.

The investigation was ongoing, the crimes listed and she knew that it was being prosecuted.....Why make the statement that pictures that were hurting our mission, our military, our international reputation, humiliation of people we want to liberate was not important? Politics, barf.

"I don't think anyone but governments themselves are under the convention."

As a Senator, Hillary is part of the government. She'd better pray that there is no way to tie her to the release of these pictures.

Neither your experience nor mine has any bearing on the facts in this case,,I suggest we both wait and see what judgements are made and eschew the pitchforks and torches and lynching materials for now.

Hillary escapes the punishment for her misdeeds. Others always pay the price for her actions.

Detest Hackworth -- he is a disgrace now! Really a shame too, but unlike some people on here, I don't give him a pass forever just because he was a war hero. His actions today are those of a bitter, old man!

Guess I'll be one of the few...

Hack did nothing wrong in helping to being this story to 'light'.

The United States has a serious problem in one part of a prison in Iraq....and there may be more 'problems' elsewhere. Bringing them to light can make it a little rough for awhile...but the United States and it's Military CAN weather it...because we (as a Nation) have always stood for something better than the rest of the world. Just because the rest of the world does wrong things to THEIR prisoners...doesn't mean that we should just sweep things like this under the rug.

It's better to have it out in the open.

..and IF those MP's get convicted....I hope they have a long stretch at Leavenworth.

Robert,

It's always a pleasure to watch an all knowing fool prove that he is also an ass. My compliments on having done such a fine job.

Bringing them to light? They have been brought to light. The whole thing was under investigation, and Gn Kapinski had been removed from the prison. Now, SOMEBODY wasn't satisfied with that. The NY Times has us believing that this is nothing more than a nasty defense case, like OJ's, where the defense plays fast and loose with "disclosure". I think it's a bit MORE than that.

So...do you think that the Republic will fall because of this???

Personally...it's good for a Nation such as ours to have these things out in the light of day...and sometimes (hell....mostimes) reports in the Military are NOT out in the light...but hidden away to protect General Officers reputations...and promotions.

"but hidden away to protect General Officers reputations..."

That hadn't happened in this case. The General (Karpinski) involved had already been removed from her command. Months ago. Now what was it about the light of day, that YOU wanted exposed?

Hack knew that people were being investigated, the commander relieved, people detained. The pictures hurt our forces in harm's way. Hack wasn't revealing anything that had not been announced by Cent Com. Pictures sensationalized it

A criminal investigation was onging.Release of the pictures may harm the prosecution, unduly prejudicing the ones who stand in judgement and the defense will use that.

Hack did it because he hates the war, the Pentagon, Rumsfield. The harm to men and women in uniform, particularly those in Iraq seem not a matter of concern to him. He is a self aggrandizing, bitter man.

At the Senate committee hearing, Hildebeast gave Rummy crap about being more concerned about the pics getting out, than about the behaviour displayed in the pics....
