This is a Hospice Patients Alliance Special Update Jan 5, 2004, sent out periodically to inform the public about news affecting hospice and end-of-life care.
We have just confirmed that ALL of Judge Baird's cases, INCLUDING the suit by Michael Schiavo v Gov Bush related to the Terri's Law, challenging its constitutionality, HAVE been transferred to Judge Nelly Khouzam. This information came directly from Judge Khouzam's assistant. Judge Khouzam is known to be a "by the book" tough, but fair judge.

The court is NOT explaining why the judges were suddenly switched, except to say that "judges rotate from time to time." We believe it might have something to do with:
Local PINELLAS COUNTY COURT BAILIFFS AND COURT EMPLOYEES WERE TAKING BETS ON WHETHER TERRI WOULD DIE OR NOT!!!
It was widely reported that Judge Baird made reckless and prejudicial comments in support of Greer and Felos and against Jeb's lawyers way before he had heard the evidence from the Governor's attorneys.
In other words, Judge Baird's comments are the likely reason local Pinellas County employees were doing "inside betting" that the local Pinellas County Judges would back each other's poor and constitutionally illegal decisions against Terri's constitutional rights and thus overrule Jeb Bush and Terri's Law. The 6th Circuit Judges are upset to have anyone tell them they are morally and legally wrong...... whether it's constitutionally illegal or not to murder Terri.
Conducting inside betting on the case is a severe violation of the code of conduct for court employees! Whether that is, or is not, the reason the judges have been switched, the very important change in judge can be extremely significant to what happens to Terri. We are hoping that Judge Khouzam will give the Gov a fair hearing in the case and allow the discovery he sought (which was denied by Baird). If Judge Khouzam allows some discovery as requested by Gov Bush, it could make all the difference!

On its face, there is something so creepy and screwy about the abuse leveled against Terri by her husband (the one living with a mistress and having babies with the same) and Felos, death monger attorney extraordinaire, it simply stuns one into the twilight zone.
Terri has put up a courageous, determined and relentless struggle to hold onto her very life. I love her. I respect her family and Attn. Conner to the max.
Thought he did a magnificent job on Greta-just flat out strong and loved that he was unwilling to let Felos go unchallanged.
Imho-Felos is out of his league with Conner. It would seem Felos has a strangle hold on the judges in Pinellas Cty-has cowed them, fooled them and caused them to choke on their own lack of knowledge. In order to maintain their legal standing, these judges have to attempt to justify past, corrupt, cruel and devastating (to Terri) rulings in Terri's case. Their own lack of understanding and judicial ethics and inquiry have brought a national furor upon them....and still they must push for Terri's death in order to justify their past failed rulings. Felos smiles, the Hospice associations go deep, no doubt money is involved, and these judges cringe and slink around the edges of consitutional law...knowing full well the depths of depravity Michael Shiavo, a first rate used car salesman, and George Felos, so evil it's visible, has taken them down a very black road. These judges are willing to let Terri die to save their own 'reputations' as worthy judges.

It has now come to my attention the Defendants in the original Malpractice trial did NOT receive the Bone Scan report, thus never had the opportunity to ask any questions about it or took action. Just as I suspected. As a past law enforcement officer d-d, I'm sure you realize the ramification of this. Mikey's house of cards is crumbling fast.
Now please do not ask for my sources d-d as the onus is not on me to prove something did not happen. You may wish to confront Mikey's lawyers tho.
This further points to the sinister nature of the whole deal, from the Very Beginning. Mikey and his lawyers knew what they were doing to deceive the courts and the public. This is blatant and willful misconduct on the part of the lawyers. But that's not surprising. They may have to face the music yet.
One of the original lawyers is Daniel J. Grieco II. He is a long time lawyer friend of Mikey, who did other work for Mikey and is still representing him for the 2001 Civil Fraud Case, which is in slow progress. Grieco is the son of the principal owner of the now defunct Agostino's Ristorante in Clearwater where Mikey worked. But there is more to this character. For those interested, you may wish to inquire about his past records with the Florida Bar.
There they were, the Schindlers naively believed it was only after Valentine's Day 1993 that Mikey cut them off to Terri's medical records, where in fact he had been hiding the Bone Scan (and what happened) all along while pursing the Big Money.
Had the Defendants got ahold of the Bone Scan, the original malpractice suit may well have a very different ending. Mikey could have ended up a resident of a Crowbar Castle instead of a Mansion, with girlfriends that have Adam's Apple instead of a mistress. Oh, sorry, that may still happen yet and Mikey may not be the only one in his crew.
For whatever reason Mikey was hiding the Bone Scan, his lawyers crossed the line by not advising him that he had to give it to the other side. Hmmm, was it his idea or theirs to begin with? They will have to answer for that now.
I wonder if the original defendants in Michael's lawsuit can sue Michael and his attorney for withholding this type of evidence from them. I know it was a civil suit, but it would be interesting to know what the rules are on evidence.
General rule and practice is that Evidence should be given to the other side as soon as possible but no later than the Discovery Stage.
It is definitely a big No-No for withholding Evidence.
What has happened to Terri is the stuff of nightmares. Except...it is real. And Terri suffers it EVERY SINGLE MINUTE.
