AUGUSTA, Maine (AP) Public health interests prevailed over warnings that personal freedoms are being eroded as the Maine House gave its final approval to a bill to ban smoking in bars and taverns.

Representatives' 95-47 enactment vote sent the measure to the Senate and put Maine a step closer to joining California and Delaware in imposing statewide bans on smoking in bars. New York's ban starts in July, and Connecticut's newly enacted ban on smoking in bars takes effect next April.

She actually smoked herself for 10 yrs and quit cold turkey. She now has asthma and tons of allergies and blames it on the smoking. Funny thing is one doctor told her she probably wouldn't have asthma now if she'd kept smoking because the tar layer in her lungs would've been sortof a protective layer for her (or something like that.)

I have heard of many things like that. Ironic health situations. Some would say that cigs actually help your health, reduction of stress, etc.

Sorry to hear of your mom's problems - but smoking does not cause asthma, nor as far as I know does it cause any allergies.

When I was a kid I never knew anyone that had asthma, and most of our parents smoked. Now a days it seems the only kids I know that DON'T have asthma are the ones with a parent or parents that smoke.

Yep its all about control, these people are the same ones who are starting to complain about perfume as well, I am waiting for the reports that second-hand perfume causes cancer. :)

The irritants to the lungs likely get the immune system working and help prevent allergies. Studies are showing now that owning pets during a child's first year helps reduce allergies and asthma because of it making their immune system work a bit harder. Same concept could apply to smoker households.

I will clarify:

Class 10 liquor license in Maine allowed smoking in an eater/pub (until Jan. 1, 2004 when the no smoking law comes into effect). Under a class 10 which could be a brew pub (as are several in Maine that brew their own beer and have other 'same name'pubs across the state..Gritty's in the Old Port or Freeport is a good example)a child even having lunch has to be accompanied by the parent. Thus, if a family on vacation stops to get burgers,lobsters as it has excellent seafood as well as serving beer, under Class 10 if a child with them is not a member of the family; he or she must be turned away or the licensee holder is fined. Even if the child is with his grandparents, the same holds true. Many of these places sit on the water and are the places to go for lobster dinners and views. Class 10 also includes the decks overlooking the harbors, for instance. The eateries have often taken great care to separate the bars from the restaurants, but this will still apply in the restaurant surroundings as well.

You ask if a child is 18 and emancipated..and the answer is then he or she has to be 21.

You asked: Can one have a child who is not one's own in a bar/restaurant if the child's parent is also present? and if you reread your question will see you still have the immediate parent present.

Tourists from other states and overseas do not know this law and would look as if you had 2 heads if you refused to serve lunch or dinner to the non-immediate family child. Some establishments may just pay the fine not to lose the business..eventually the eatery could lose its license. It is patrolled by the eatery/pub owners/staff themselves as law enforcement would be called in usually by a 'concerned citizen'.

After Jan. 1, the Class 10 will be dropped as no smoking is allowed. Now the question many owners have is can they allow smoking in areas outside on decks etc. If you step into the drive areas to have a smoke, then it is illegal to hold a drink at that point.

The eateries/pubs say they do not have the money to lobby, and working long hours in their resturant/pub business it becomes difficult to hold meetings to form a unified voice on this issue.

Therefore, after the no smoking law comes into effect,does that mean anyone with anyones child can come into a liquour serving establishment for dinner?

But as the smoker exhales, he is violating the rights of everyone around him to breathe smoke-free air.

What if there isn't anybody around him who particularly wants to breathe smoke-free air?

I:Lack of tolerance and being self absorbed is the "life choice" of the anti's. I say we ban intolerance and self absorption....

Seems the anti's detests everyone and everything, small wonder they are stressed and edgy, they spend all their energy on hate, hate is a very taxing emotion.

Yes, nicotine and addiction is a load, nicotine leaves the body in 36 hours, yet I know people who quit over 20 years ago, they admit to still wanting a smoke

I will readily admit that I am addicted to smoking. However, given the alternatives on the market which will conteract the very short term chemical attraction, I have come to accept the fact that my addiction is entirely psychological which can not be overcome with drugs. And for what it's worth, I enjoy smoking and that is my psychological problem......

I agree, smoking is a habit one enjoy's, I have no intention to stop......... going on 69 years, life would only seem longer if I quit. :-}

We should find a way to measure a person's stress, then tax that individual based on their stress levels. That way we could afford to care for them when they have the strokes and heart attacks at 45!

I am not sure if you are responding to me or if you are giving me ammunition to deal with that particular anti. It is a good point though, as the bans are taking place the anti's are not frequenting the bars that they confiscated property from the rightful owner.

Addiction is one thing. Liking something alot is another. The whole point is everyone I know that truly wanted to quit without someone pressing them, quits. I don't want to quit and you don't want to quit, because we like it. If either of us ever decides we really want to quit we will. I'm not addicted to sex but I don't plan to quit.
