A top Housing Authority official has smoked himself out of an $80,000-a-year job.

After consulting with the mayor's office, Housing chairman Tino Hernandez yesterday ordered the immediate firing of Robert Swinton, the deputy director of the Office of Facility Planning, one of five employees spotted by a Post reporter last week in extended smoking sessions outside the agency's headquarters at 250 Broadway.

I own up to my mistakes - I did misread.

However - my scenario still can hold true.

I would venture to say based on the position he holds - this guy is not a regular employee (they call them exempt around here)and most likely puts in closer to 60 than 40 hours a week.

That not withstanding - this guys crime is not how much time he spent taking smoke breaks - but the fact that the New York Post wrote a story about it at the time the Mayor is trying to rid the city of smokers.

The anti smokers (not referring to you) have brought upon themselves the anger of the smokers because in their book there is no compromise. For years designated areas, including private offices for smoking workers worked just fine. But that wasn't good enough - so smoking allowed break rooms were created....but then that wasn't good enough. Smokers got kicked out of the building and the antis started whining about smokers outside the buildings. Now they just whine - period.

Private businesses in Delaware that created enclosed outside smoking areas for their emplioyees, at their own expense in order to comply with state law will no longer be able to utilize them come Novemeber 27, when the state wide smoking ban goes into effect. Smoking will no longer be permitted in any enclosed building except private homes.

That is stealing from taxpayers as well. when a taxpaying business spends money to comply with a law and it is changed with no recourse - the government is stealing from the taxpayer and thus the smokers.

Sorry, I don't work for the government. I've been self-employed for more than 15 years. And I won't be hiring anyone real soon. Because I work from home, if I hire anyone I would be prohibitted from smoking in my own home.

On the other hand if I were considering hiring - I would only hire smokers knowing no one would go running to the smoke police.

And that is not illegal - it's perfectly legal in Delaware (and about 20 other states) to refuse to hire someone who doesn't smoke. Just like it's perfectly legal to refuse to hire smokers.

Thank you.

He plans on keeping it up until Election day. In order for everyone to get the message - along with his daily specials he's switching it from the north bound facing side to the southbound facing side every day!!!!

I'm sure you can figure out where I will be after the polls close watching the returns this year!!!!!!

I have observed guys at work who smoke(construction outdoors) and you never see them lighting up and standing around smoking. Yet they smoke a lot. I have seen others who think they have a right to stand around and smoke while others are working.
It amazes me how smooth a few men are at lighting up and smoking while never slowing down or missing a beat.
I get rid of anyone who stops and smokes in a hurry.

Its stealing... that's the point to be made here... NYC is running a huge deficit... it can hardly afford to keep employees who steal from the city...

Then run for office. Get in there and make a difference!

Why don't you worry more about your own job and let the boss take care of the others. I have the feeling your using more time taking notes about people taking breaks then getting your own work done. If your as busy as you claim, then how do you have time to take note of everyone else's breaks?

'Government is stealing from taxpayers when they tell me if I hire an employee I am no longer able to smoke in my home.

Government is stealing from taxpayers when small businesses lose money because government threw the smokers outside.

Government is stealing from taxpayers when they force government employees out on the street.

Government employees are taxpayers too - and smokers pay more taxes to the government - particularly NYC government employees who choose to smoke.
