The last night the Senate was in session, they had some particular thing read into the record regarding Otto Reich - I didn't understand what its purpose was. Harry Reid, I believe, was the RAT who was on the floor at that time, after Daschole and gang had already left town. I wondered if they'd done something that would prohibit Bush from doing this but I'm glad to see he's (at least trying or) doing the right thing!

WASHINGTON (AP) - Circumventing Senate opposition, President Bush (news - web sites) signed recess appointments Friday for conservatives Otto Reich and Eugene Scalia.
A senior administration official, speaking on condition of anonymity, said the White House gave Congress formal notification of the long-threatened appointments early Friday afternoon.
By exercising his executive authority while Congress is in recess, Reich and Scalia will be allowed to serve until Congress recesses again at the end of the year.

Recess appointments--they can stay on until the end of the next Senate session. The US Constitution is a living document, there are new rules, Bill Lan Lee was a recess appointment that lasted until Clinton left office.

I've been told by a reputable source that recess appointments can be made, but that the appointment is only good until the next congress gets seated. US Constitution, Article II, section 2, paragraph 3:
The President shall have Power to fill up all Vanancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next session

Circumventing Senate opposition . . . This isn't exactly correct. If the Senate really opposed these nominations they would have voted to reject them. The headline should actually read: "Circumventing a dormant Senate mired in self-imposed gridlock . . ."
