A NATION CHALLENGED: IMMIGRATION; Suspects in Hijackings Exploited Loopholes in Immigration Policy
By DIANA JEAN SCHEMO and ROBERT PEAR
Source: The New York Times

Abstract
Hijackers who flew airliners into World Trade Center and Pentagon exploited immigration system that critics contend is riddled with loopholes and that is geared to ease the way for commerce, whether in form of tourism, business or study; experts on terrorism say security precautions often take back seat to pressure from industry, concerns of neighboring governments and even bureaucratic rivalries in US government; say sheer volume of daily border crossings--300 by land from Mexico alone--make exclusion of all foreign terrorists impossible; photo (M)

Five Israelis Held In New York

October 25, 2001

Five young Israelis are "on the verge of collapse," according to family members, as their incarceration in New York on charges relating to the Bin Laden attacks continues. They were arrested on Sept. 11, only hours after the World Trade Center attack, on charges of "plotting to blow up" a New York bridge.

Katie Shmuel of the Galilee town of Yokne'am, southeast of Haifa, says that her son Yaron is in "a very critical psychological situation," given that they are not allowed to have visitors and the difficult conditions in which they are being held. "Even the Israeli Consul-General in New York was allowed to visit only after asking several times and receiving a special permit," Katie told Arutz-7's Yosef Zalmanson today. "He was allowed to talk to them only in English, and only from behind a glass partition. The Consul told me that the boys are in a bad state and that they are being held under difficult conditions."

When asked why the five youths, aged 22-26, are being held, Katie replied with despair: "It's ludicrous. They were on the George Washington Bridge [between upper Manhattan and New Jersey] at the time of the bombing, and the FBI had warnings of a terrorist plot, of guys in a white van, to blow up the bridge. So when the FBI saw this van, with my son and his four friends - one of them had a large sum of money, there were two razor knives in the van, and one of the boys is named Omer, which the FBI guys thought was Omar - they put one and one together and got three, and immediately arrested them... For the first few days, the boys were held in an FBI dungeon, tied up, with no clothes and no food." She said that original reports that they had been arrested while boisterously watching the disaster from a rooftop "are totally fabricated. For one thing, they weren't even on a roof, they were in a van..."

When asked how she explains her son's continued incarceration and that of his friends, she said, "I truly have no explanation for this incredible story - except this: The Americans are using them as pawns to pressure the Israeli government. Am I being clear enough?" She said that President Moshe Katzav and others had attempted to intervene, but there have been no results so far. The youths are being held in the Metropolitan Detention Center in Brooklyn.

A spokesperson for the Israeli Consulate in New York told Arutz-7 that in the wake of the Sept. 11 attacks, "the Americans now have different procedures for dealing with the detention of anyone arrested in connection with the attacks. Every single request of ours must go through the FBI and the State Department's legal team." She said, "We are doing as much as we possibly can on their behalf," including, she said, getting local Jewish leaders involved in the cause of the imprisoned young Israelis.

Are you a DA in Fresno?

I went to law school with a guy whom, I've been told, is now a DA in Fresno. Despite being a nice guy, he didn't understand beans about economics. Hmmmm .... did you go to law school in San Diego, by any chance?

How Do I Renew My Permanent Resident Card (Green Card)? (Color added for effect!!)

What is a Permanent Resident Card?

A Permanent Resident Card, commonly known as a Green Card, is evidence of your status as a lawful permanent resident with a right to live and work permanently in the United States. It also is evidence of your registration in accordance with United States immigration laws. The Permanent Resident Card is also called INS Form I-551.

What Does the Law Say?

Section 264 of the Immigration and Nationality Act provides that, "Every alien in the United States shall be issued a certificate of alien registration or an alien registration receipt card in such form and manner and at such time as shall be prescribed under regulations." It also states, "Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him. Any alien who fails to comply with [these] provisions shall be guilty of a misdemeanor." The specific requirements and procedures for applying to renew an expiring permanent resident card are set forth in the Code of Federal Regulations [CFR] at 8 CFR § 264.5.

Who Should Renew a Permanent Resident Card?

You should renew your permanent resident card if you are a permanent resident who was issued a Form I-551 valid for ten years, and that card is either expired or will expire within the next six months.

Please note: If you are a Conditional Resident and your status is expiring, these instructions do not pertain to you. You are to use INS Form I-751 (Petition to Remove the Conditions on Residence) to apply to remove the conditions on your permanent resident status.

How Do I Apply to Renew My Permanent Resident Card?

If you are a lawful permanent resident whose ten-year I-551 has expired or will expire within the next six months, you may renew your card by filing an INS Form I-90.

Please Note: This procedure should NOT be used by lawful permanent residents who are seeking to replace their permanent resident cards for reasons other than expiration of the card’s ten-year validity. For those seeking to replace their permanent resident cards for reasons unrelated to the ten-year expiration date (e.g., because the card has been lost, stolen, mutilated, or because biographical data has changed or is incorrect), please see How Do I Replace My Permanent Resident Card.

Exception: You may, however, request to change your name on your new card (because of marriage, legal name change, or divorce) at the time you file your application for a renewal card. To do so, you must provide a copy of your marriage certificate, divorce decree or court order as evidence of the legal name change.

A Form I-90 can be ordered by calling the INS Forms request line at 1 (800) 870-3676, or by submitting a request on-line here. It is not possible to submit forms to INS on-line at this time.

After receiving Form I-90, read it carefully and note the documentation and photos that must be submitted. Detailed information is provided in the instructions for the Form I-90. Unless otherwise instructed, you should file the application (with supporting documentation and fees) in person at the appropriate INS Application Support Center (ASC) serving the area where you live. Please note that a few ASCs are unable to accept I-90 applications. For specific information on where to submit your application, please see the home page of the local office servicing the area where you live or call the National Customer Service Center at 1-800-375-5283.

If you are otherwise eligible, at the time you file your Form I-90, you will be provided with temporary evidence of your lawful permanent residence status. If your renewal application is approved, you will be mailed a new Permanent Resident Card with a ten-year expiration date.

What If I am Outside of the United States?

If you are outside the United States, and your permanent resident card will expire within six months, (but you will return within one year of your departure from the United States and before the card expires), you should file for your renewal card as soon as you return to the United States.

If you are outside of the United States at the time of the card’s expiration, and you have not applied for the renewal card prior to your departure, you should contact the nearest American Consulate, INS office, or Port of Entry, before attempting to file Form I-90 for a renewal I-551 card.

For more information on INS office locations, click here. For information on filing fees, see INS filing fees, fee waiver request procedures, and the INS fee waiver policy memo.

How Can I Find Out the Status of My Application?

To check the status of your application, please contact the INS Service Center that receipted your application. You should be prepared to provide the INS staff with specific information about your application, such as the ten-digit receipt number printed on your Form I-797, Notice of Receipt, your Alien Registration Number, name, and date of birth. Please click here for complete instructions on checking the status of your application. Please click here for more information on INS offices. It is not possible to check the status of your application on-line at this time.

If My Application is Denied How Can I Appeal?

If your application for a renewal of your permanent resident card is denied, you will receive a letter that will tell you why the application was denied. You will not be allowed to appeal a negative decision. However, you may submit a motion to reopen or a motion to reconsider with the same office that made the unfavorable decision. By filing such a motion, you may ask the INS office to reexamine or reconsider its decision. A motion to reopen must state the new facts that are to be provided in the reopened proceeding and must be accompanied by the appropriate documentary evidence. A motion to reconsider must establish that the decision to deny your application was based on an incorrect application of law or INS policy, and further establish that the decision was incorrect, based on the evidence in the file at the time the decision was made. For more information, please see How Do I Appeal the Denial of Petition or Application?

Can Anyone Help Me?

If advice is needed, you may contact the INS District Office near your home for a list of organizations who can assist you with the preparation and filing of your application. Please click here for more information on INS field offices; then, see the bottom of the About Us section for the field office serving your area for a listing of assistance organizations.

This won't happen until 250,000 Americans are slaughtered

I don't know if it will take 250,000 but I do know that right now the USA is trying to stay in "business as usual" mode and ignoring the fact that we are the targets of a global war by maniacal fanatics, many of whom are living in our country, visiting here on legal travel visas. I hope it doesn't take 250,000 American deaths to open our eyes to the truth. Sadly, 6,000 deaths seems to have done little to wake us up. I am very depressed about the near future for all Americans. We are not going on the offensive in our own country. The war in Afghanistan is going well. But inside our own country we are (I'm sorry to say) taking a Clinton-like do-nothing love-everyone attitude towards our current perilous situation.

Your proposal sounds nice until you really think about it. Then it makes no sense. Many foreigners work here. Yes, alot of them are gardeners, and their deportation wouldn't have a significant economic impact. But many foreigners work in high-tech jobs or in financial jobs. NY City is the center of the financial world, and eliminating foreigners would decimate NY City, which in turn would decimate our economy. Your proposal would kill high-tech, would kill financial services, and would make us very poor. No thanks. We've always had something of an open door policy, and that's why we're strong: because we get the best and brighest from other countries. Look at Indians (the dot kind, not the feather kind). Many of them in this country are hard working, entrepreneurial, and contribute a great deal to our economy. Then look at India: the place is a mess. Why is there this disparity? Because many of the best and brighest Indians left India and came here because there's opportunity here! And we're better off too: they spend their money here, for the most part, and help grow our corporations.

Since you didn't provide a link we don't really know if "some doctor beat up an Afghani taxi driver in San Diego", do we?

And if it's true that there are random acts of violence being committed against suspect groups, I would say its out of understandable frustration that the government is not responding to the threat within. Hell, FR isn't really responding to the threat within. We post a bunch of angry words but where is the leadership, the organization, the petition-drive, the email campaign that this issue demands? I wish I were the leadership type. I am not. I am waiting for a leader to emerge. So far I see none. Not in the political arena. Not on the internet. So far, not anywhere.

This needs to be repeated over and over again... and then again. We are in the amazing situation to attract the best educated and most entrepreneurial people from all over the world. I only need to have a look around our MBA program (I am an academic) - 40% foreigners from close to 100 countries. Most of them will stay subsequently and contribute to the US. These are the people this country needs, and kicking them out would be plain insanity.

This whole idea is silly. You will have a few hundred thousand people with "sponsors." Then you will need to verify those sponsors. Can you imagine the resulting bureaucracy? This will bog down the law enforcement people. And now is the time for well-focused investigative work, not mass deportations.

Not to mention the tremendous hit to the GDP. And stirring strong racist sentiments. Plus, as I said, there are much better solutions.

A much better approach is to recruit informants in these various cells. Identify those that have pro-violence tendencies, then focus investigative resources there.

If we waste precious resources rounding middle-easterners, 99.8% of whom have zero terrorist sympathies, we're not making US safer. We're wasting resources, and that makes US less safe.

Agree. We need to intern every alien who fits the profile (male, 20-50, citizen of a suspect nation). We also need a moratorium on light aircraft for the duration, and a bunch of other emergency measures which I can't even begin to imagine. Bush should declare a National State of Emergency to establish the appropriate context and mindset we need to round up Saddam's operatives. We won't get any of these things until it is too late, I'm afraid. Or maybe we'll just give Saddam a pass, and hope that he leaves us alone from now on.

I didn't say that. I'm all for enforcing the law and if someone - anyone - is here illegally then they should be deported. But that isn't what rmlew said was that we should expell all Muslims here on student visas period. And then argue against the same for some other ethnic group on the grounds that it would punish the innocent with the guilty. Seems like a double standard to me.
